1.1.4 Requirements <strong>for</strong> an Application <strong>for</strong> a Rateable Take Order (file 12 copies)<br />

Requirements<br />

1) A statement of what is being requested,<br />

including<br />

a) a reference that the application is being<br />

made under Section 36 of the OGCA,<br />

<strong>and</strong><br />

Comments<br />

For example, HP <strong>Gas</strong> Company applies <strong>for</strong><br />

an order under Section 36 of the OGCA<br />

distributing gas production among wells in<br />

the Woodword Viking A Pool, which<br />

includes the wells with the unique identifiers<br />

of …<br />

b) the pool <strong>and</strong> wells to which the order<br />

would apply.<br />

2) A discussion giving the reasons why you are<br />

requesting the order, including a description<br />

of the circumstances that in your opinion<br />

have led or will lead to an inequitable<br />

situation.<br />

3) Documentation showing your attempts to<br />

negotiate a solution to the problem,<br />

including<br />

a) identification of all parties involved <strong>and</strong><br />

the nature of their issues <strong>and</strong> concerns,<br />

<strong>and</strong><br />

b) an outline of the attempts to resolve the<br />

issues, including type of discussions<br />

held, timing, <strong>and</strong> frequency.<br />

You must have made substantial ef<strong>for</strong>ts to<br />

resolve the situation; the application should<br />

be a final resort. You should also continue<br />

your ef<strong>for</strong>ts to resolve the matter on a<br />

voluntary basis (including consideration of a<br />

third-party mediator) after the application has<br />

been filed with the ERCB.<br />

Your discussion must include why the<br />

negotiations did not lead to a settlement <strong>and</strong><br />

what dispute resolution ef<strong>for</strong>ts were<br />

conducted. Matters of confidentiality <strong>and</strong><br />

disclosure should be addressed <strong>and</strong><br />

determined by the parties prior to submission<br />

of the application.<br />

4) Your geological interpretation of the pool<br />

involved, including<br />

a) a net pay isopach map of the pool,<br />

including both oil <strong>and</strong> gas if there is an<br />

associated pool,<br />

b) an interpreted <strong>and</strong> annotated log crosssection<br />

or representative well log(s)<br />

showing<br />

i) stratigraphic interpretation of the<br />

zone(s) of interest,<br />

This in<strong>for</strong>mation should show that your well<br />

is part of the subject pool. The net pay map<br />

should show the entire pool <strong>and</strong> illustrate<br />

wells outside the pool that control the edges<br />

of the pool.<br />

If there is a dispute among the parties<br />

involved regarding the delineation of the<br />

pool(s) in question, an annotated crosssection<br />

should be included in the application;<br />

if there is no dispute respecting this issue, an<br />

annotated representative well log is<br />

sufficient <strong>for</strong> the purposes of the application.<br />
