Table 3.1 Notification Requirements <strong>for</strong> Commingling <strong>Applications</strong><br />

You must send notice of the proposed<br />

If you are applying <strong>for</strong> commingling because<br />

commingling at minimum to<br />

1) the proposed commingling is <strong>for</strong> a situation where<br />

• there is actual or anticipated water production equal<br />

to or greater than 5 m 3 /month in a well with<br />

per<strong>for</strong>ations above the base of groundwater<br />

protection (BGWP),<br />

• there are unresolved equity issues with respect to<br />

the proposed commingling, or<br />

• there is a water well within a 600 m radius with a total<br />

depth less than 25 m from the top of the per<strong>for</strong>ations<br />

of the well proposed <strong>for</strong> commingling.<br />

2) the proposed commingling is <strong>for</strong> a situation where<br />

• the reservoir pressure of a pool or interval proposed<br />

<strong>for</strong> commingling exceeds 90 per cent of the lesser of<br />

the closure or breakdown fracture pressure of one of<br />

the other pools or intervals proposed <strong>for</strong><br />

commingling, or<br />

• the well is in a designated oil s<strong>and</strong>s area or is in a<br />

pool overlapping a designated oil s<strong>and</strong>s area.<br />

3) the proposed commingling is <strong>for</strong> a situation where<br />

• the commingled stream contains H 2 S,<br />

• the commingled stream contains oil, associated gas,<br />

<strong>and</strong>/or nonassociated gas,<br />

• there are two or more oil pools with production<br />

greater than 3 m 3 /day from any well in any pool,<br />

• there is a pool(s) subject to an existing or proposed<br />

enhanced recovery scheme, or<br />

• commingling of production would address an<br />

operational issue not specifically detailed in this<br />

directive.<br />

• well licensees of nonab<strong>and</strong>oned wells in the<br />

st<strong>and</strong>ard 1 DSU where the subject well is located<br />

<strong>and</strong> in the eight st<strong>and</strong>ard DSUs offsetting the<br />

subject well,<br />

• Freehold lessors in the st<strong>and</strong>ard DSU where the<br />

subject well is located <strong>and</strong> in the eight st<strong>and</strong>ard<br />

DSUs offsetting the subject well, <strong>and</strong><br />

• the owner(s) of water well(s) within the 600 m<br />

radius <strong>and</strong> 25 m depth.<br />

• well licensees of nonab<strong>and</strong>oned wells in the area<br />

of the smaller of the pools proposed <strong>for</strong><br />

commingling <strong>and</strong> in the st<strong>and</strong>ard DSUs offsetting<br />

the smaller of the pools, 2 or if the smaller pool is<br />

a single-well pool, in the st<strong>and</strong>ard DSU where the<br />

subject well is located <strong>and</strong> in the eight st<strong>and</strong>ard<br />

DSUs offsetting the subject well, <strong>and</strong><br />

• Freehold lessors in the area of the smaller of the<br />

pools proposed <strong>for</strong> commingling <strong>and</strong> in the<br />

st<strong>and</strong>ard DSUs offsetting the smaller of the pools,<br />

or if the smaller pool is a single-well pool, in the<br />

st<strong>and</strong>ard DSU where the subject well is located<br />

<strong>and</strong> in the eight st<strong>and</strong>ard DSUs offsetting the<br />

subject well.<br />

• well licensees of nonab<strong>and</strong>oned wells in the<br />

pools proposed <strong>for</strong> commingling, 3 <strong>and</strong><br />

• Freehold lessors in the area of the smaller of the<br />

pools proposed <strong>for</strong> commingling <strong>and</strong> in the<br />

st<strong>and</strong>ard DSUs offsetting the smaller of the pools,<br />

or if the smaller pool is a single-well pool, in the<br />

st<strong>and</strong>ard DSU where the subject well is located<br />

<strong>and</strong> in the eight st<strong>and</strong>ard DSUs offsetting the<br />

subject well.<br />

4) the proposed commingling is <strong>for</strong> an area. • well licensees of nonab<strong>and</strong>oned wells in the area<br />

of application <strong>and</strong> in the st<strong>and</strong>ard DSUs offsetting<br />

the area of application, <strong>and</strong><br />

• Freehold lessors in the area of application <strong>and</strong> in<br />

the st<strong>and</strong>ard DSUs offsetting the area of<br />

application.<br />

For a gas well, a st<strong>and</strong>ard DSU is one section; <strong>for</strong> an oil well, a st<strong>and</strong>ard DSU is one quarter section. If the proposed commingling<br />

mixes oil <strong>and</strong> gas, notice must be provided <strong>for</strong> the larger DSU involved.<br />

Area of pool as defined by ERCB, or if the ERCB has not defined the pool when the notice is provided, the area of the pool as<br />

interpreted by the applicant. The ERCB may request the applicant to provide notice to additional parties if during the evaluation of<br />

the application the ERCB interprets the pool area to be larger than interpreted by the applicant.<br />

If a pool involved is extremely large, the applicant must make a judgement as to what area of the pool should be covered in the<br />

notification. This judgement would involve an assessment of which parties might be impacted by the proposed commingling. The<br />

ERCB may request the applicant to provide notice to additional parties if the ERCB considers that insufficient notice was provided.<br />
