3.1.3.4 Compliance Assurance<br />

With the implementation of the new DE <strong>and</strong> SD processes, the ERCB has substantially<br />

strengthened its surveillance, audit, <strong>and</strong> en<strong>for</strong>cement processes to ensure that it is more<br />

effective in identifying <strong>and</strong> dealing with potential unauthorized commingling <strong>and</strong> other<br />

related noncompliant situations. En<strong>for</strong>cement action <strong>for</strong> any noncompliance with<br />

commingled production requirements will be in accordance with <strong>Directive</strong> 019.<br />

The ERCB believes that it is prudent <strong>for</strong> licensees to proactively review their wells to ensure<br />

that all production operations are in compliance with the regulations <strong>and</strong><br />

<strong>Directive</strong> <strong>065</strong>. Licensees should disclose any instances of unauthorized commingling in<br />

accordance with the requirements of Section 6 of <strong>Directive</strong> 019.<br />

If there is commingling without approval, a licensee may qualify to use the DE or SD process<br />

described in this section to restore compliance in lieu of submitting a complete application.<br />

In some compliance situations, pool designation may be an issue. The operator or licensee, as<br />

defined in the <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong> Conservation Act, must comply with the current ERCB pool<br />

designation <strong>and</strong> is expected to make a technically sound assessment of pool interpretations.<br />

Current ERCB pool designation in<strong>for</strong>mation may be found on the official site <strong>for</strong> ERCB Field<br />

<strong>and</strong> Pool Orders at ERCB Home : Industry Zone : Industry Activity <strong>and</strong> Data: BOS - Board<br />

Order System. Field <strong>and</strong> pool orders are updated monthly.<br />

Further in<strong>for</strong>mation about pool designations can be obtained by contacting the ERCB by<br />

telephone at (403) 297-8311 (Customer Contact Centre) or by e-mail at<br />

PoolDesignation@ercb.ca.<br />

If there are questions regarding pool interpretation in a compliance situation, the ERCB will<br />

notify the licensee directly in writing. The licensee will have an opportunity to respond to<br />

new evidence or rulings on complex or unclear situations in four ways. The licensee may<br />

• qualify to use the DE or SD process described in this section to restore compliance,<br />

• segregate pools in the well,<br />

• submit a complete commingling application under <strong>Directive</strong> <strong>065</strong> requirements to restore<br />

compliance, or<br />

• submit a technically supported pool delineation application in accordance with <strong>Directive</strong><br />

<strong>065</strong>.<br />

Failure to respond within the specified timeframe to an ERCB request regarding<br />

noncompliance or pool delineation issues results in en<strong>for</strong>cement action in accordance with<br />

<strong>Directive</strong> 019.<br />

3.1.3.5 Notification Requirements <strong>for</strong> Commingling<br />

A licensee or applicant must provide notification of commingling when using any of the three<br />

processes <strong>for</strong> the management of commingling: DE, SD, or application. The requirements <strong>for</strong><br />

proper notification vary <strong>for</strong> each of the processes <strong>and</strong> must include well <strong>and</strong> interval details in<br />

accordance with the following requirements.<br />

Sample notice letters <strong>for</strong> commingling are in Appendix B.<br />
