Except in cases involving missing <strong>and</strong> untraceable owners or minor amendments to existing<br />

pooling orders, once an application is complete the ERCB normally issues a notice of<br />

application. The notice of application would not usually be published in any newspapers but<br />

would be sent directly to parties with an interest in the petroleum <strong>and</strong>/or natural gas<br />

underlying the DSU. Interested parties would have a specified time period in which to file<br />

any objections or concerns they may have respecting the application.<br />

If no objections or concerns are received in response to the notice of application, the ERCB<br />

makes a decision on the application without further notice or a hearing. If a valid objection to<br />

an application is filed, the ERCB schedules a public hearing to consider the application <strong>and</strong><br />

the issues raised.<br />

1.5.3 Requirements <strong>for</strong> an Application <strong>for</strong> a Compulsory Pooling Order (file 12 copies)<br />

Requirements<br />

1) A statement of what you are requesting,<br />

including<br />

a) a reference to the section(s) of the<br />

OGCA under which you are making the<br />

application, <strong>and</strong><br />

b) the legal description of the DSU<br />

involved.<br />

Comments<br />

You should cite Section 80 of the OGCA <strong>and</strong>,<br />

if applicable, Sections 85 <strong>and</strong> 86. For<br />

example: Company X is applying <strong>for</strong> a<br />

compulsory pooling order <strong>for</strong> the production<br />

of gas under Section 80 of the OGCA in the<br />

DSU constituting Section 13-45-12W4M.<br />

The size of the DSU involved should be<br />

consistent with the substance to be pooled<br />

(oil or gas). Thus, oil would normally be<br />

pooled within a st<strong>and</strong>ard oil DSU of a quarter<br />

section, while gas would be pooled within a<br />

st<strong>and</strong>ard gas DSU of one section.<br />

Compulsory pooling occurs only within a<br />

single DSU. Section 80 of the OGCA does<br />

not allow <strong>for</strong> compulsory pooling within<br />

several DSUs.<br />

2) A statement providing the legal description<br />

of each tract within the DSU <strong>and</strong> the<br />

ownership of that tract, together with a table<br />

showing the mailing addresses <strong>for</strong> all lessors<br />

<strong>and</strong> lessees (except the Crown).<br />

For example. <strong>for</strong> the gas DSU constituting<br />

Section 13-45-12W4M:<br />

You should provide the mailing addresses of<br />

all lessors (except the Crown) <strong>and</strong> lessees as<br />

an attachment to the application. This allows<br />

the ERCB to provide notice of the<br />

application to all potentially adversely<br />

affected parties.<br />
