14) If you are requesting, pursuant to Section 56<br />
of the OGCA, that the proposed order be<br />
effective prior to the date the order is issued<br />
but not prior to the date the application <strong>for</strong><br />
the order was made to the ERCB, a<br />
discussion as to why the order should be<br />
effective on the requested date, including<br />
a) the steps that you have taken to market<br />
your production, <strong>and</strong><br />
b) an indication of whether or not your well<br />
is tied into a gathering system <strong>and</strong>, if not,<br />
why the order should be made on a<br />
retroactive basis.<br />
15) If you are requesting, pursuant to Section<br />
55(2) of the OGCA, <strong>for</strong> the ERCB to set the<br />
price that the common purchaser shall pay<br />
<strong>for</strong> the gas to be taken under a common<br />
purchaser order,<br />
a) a discussion <strong>and</strong> documentation<br />
indicating what negotiations were carried<br />
out respecting the price to be paid <strong>and</strong><br />
where the impasse lies, <strong>and</strong><br />
b) a statement of the price you propose be<br />
paid <strong>for</strong> the gas, together with a detailed<br />
discussion of how this price was<br />
obtained <strong>and</strong> why you believe the price<br />
proposed is fair in comparison to the<br />
price offered.<br />
If you are not asking the ERCB to set the price<br />
of the gas to be taken by the common<br />
purchaser, you do not need to include the<br />
in<strong>for</strong>mation noted in item 15.<br />
Your response to item 15(a) may be combined<br />
with your response to item 8. Normally, the<br />
ERCB would consider setting the price to be<br />
paid <strong>for</strong> the gas to be sold under a common<br />
purchaser order only if there were a specific<br />
dispute on the price issue. There<strong>for</strong>e, if you<br />
are requesting the ERCB to set the price, you<br />
must show that this is a specific area of<br />
dispute <strong>and</strong> that you have made substantial<br />
ef<strong>for</strong>ts to negotiate a resolution to the matter<br />
prior to making this request.<br />
