propose to drill or from which you propose<br />

to produce.<br />

Comments<br />

The <strong>for</strong>mation subject to the pooling order<br />

would be cited in the order. In previous<br />

pooling applications where there has been a<br />

dispute about which <strong>for</strong>mations should be<br />

subject to a pooling order, the ERCB decided<br />

to limit the <strong>for</strong>mation subject to the order to<br />

the known productive zone or to the major<br />

productive zone (Examiner Reports<br />

91-6 <strong>and</strong> 95-2).<br />

4) A statement that an agreement to operate the<br />

tracts as a unit cannot be made on<br />

reasonable terms.<br />

5) The particulars of the ef<strong>for</strong>ts you have made<br />

to obtain a voluntary agreement, including<br />

a) identification of all parties involved <strong>and</strong><br />

the nature of their issues <strong>and</strong> concerns,<br />

b) an outline of the attempts to resolve the<br />

issues, including type of discussions<br />

held, timing, <strong>and</strong> facilities, <strong>and</strong><br />

c) an indication of your view of why<br />

attempts to obtain a voluntary pooling<br />

arrangement have failed in each case.<br />

You should have made substantial ef<strong>for</strong>ts to<br />

negotiate a voluntary pooling arrangement.<br />

The application should be a last resort. You<br />

should also continue your ef<strong>for</strong>ts to resolve<br />

the matter on a voluntary basis (including<br />

considerations of a third-party mediator) after<br />

filing the application with the ERCB.<br />

Your discussion must include why the<br />

negotiations did not lead to a settlement <strong>and</strong><br />

what dispute resolution ef<strong>for</strong>ts were<br />

conducted. Matters of confidentiality <strong>and</strong><br />

disclosure should be addressed <strong>and</strong><br />

determined by the parties prior to submission<br />

of the application.<br />

A description of your ef<strong>for</strong>ts to resolve the<br />

situation should include a summary of<br />

telephone calls <strong>and</strong> meetings <strong>and</strong> copies of<br />

relevant correspondence.<br />

6) If there is a well on the DSU that is to be<br />

produced under the proposed pooling order,<br />

a statement of the unique identifier of the<br />

well <strong>and</strong> its producing <strong>for</strong>mation or<br />

<strong>for</strong>mations.<br />

7) If there is not a well on the DSU drilled to<br />

the <strong>for</strong>mation(s) referred to in item 3, a<br />

statement indicating the location (LSD) of<br />

the well to be drilled.<br />

The well to be subject to the pooling order<br />

would be cited in the pooling order.<br />

The proposed well location would be<br />

included in the pooling order.<br />
