) ) 2. La evolución contractual en materia laboral 103 El contrato de trabajo pasó por muchas vicisitudes antes de haberse podido desligar de los contratos civiles. Durante muchos años el contrato laboral fue asimilado al contrato de arrendamiento, ya que se sostenía que así como una persona podía rentar una casa, a cambio de una renta, también otra persona podía rentar los servicios de un trabajador a cambio de un salario. Dicho criterio fue finalmente desvirtuado por Phillippe Lotmar, en Alemania cuando manifestó que no era posible dicha asimilación de contratos, en virtud de que al terminarse el contrato de arrendamiento tenia que devolverse la cosa arrendada y al terminarse el contrato de trabajo no era posible que se devolviera la energía utilizada. Cuando parecía que el contrato de trabajo iba a tener una vida propia laboral, Carnelutti argulló en Italia que el contrato de trabajo se equiparaba a un contrato de compra-venta (salvando con ello el escollo de la devolución de la cosa a la terminación del contrato). Adujo que asi como era factible comprar la energía eléctrica, se podria comprar también la energía humana. Cuando se argumentó en contra que la persona humana no podría comprarse o venderse en el mercado, Carnelutti replicó que no se compraba la persona humana, sino simplemente su energía, así como tampoco se compran las máquinas que producen energía eléctrica, sino simplemente sus efectos; con ello el contrato de trabajo quedó inmerso dentro del contrato de compra-venta por mucho tiempo. Pero con el devenir de los años, el contrato de trabajo se llegó a desvincular del contrato de compra-venta en virtud de que éste es instantáneo y en el momento en que se celebra se extingue la vinculación entre las partes y en cambio elcontrato de trabajo es precisamente de "tracto sucesivo" y sus efectos empiezan a producirse para el futuro, precisamente en el momento en que se celebra. Chatelain y Valverde sostuvieron que el contrato de trabajo se equiparaba al contrato de sociedad, ya que así como había en este contrato socios capitalistas y socios industriales, que incluso tenían derecho a una participación en las utilidades de la empresa. La objeción a dicho criterio consiste en que en el contrato de sociedad siempre se forma una persona moral distinta a la de los socios lo que no acontece en el contrato de trabajo. Por lo tanto, el contrato laboral dejó de ser considerado como un contrato de sociedad y evolucionó en su forma más simplista a un contrato individual verbal. Todavía nuestra anterior legislación de 1931 contemplaba la posibilidad de contratos individuales verbales en el caso de los servicios domésticos o de trabajos por menos de 30 días. El contrato de trabajo individual y verbal evolucionó a su vez a un contrato individual escrito, posteriormente a contrato colectivo de trabajo y finalmente a contrato-ley.
