1. La obligación de capacitar en la ley de 1970 Una de las obligaciones naturales que se deriva de la relación laboral es sin duda alguna no sólo la obligación que tienen los patrones de capacitar a sus obreros, sino muy particularmente la conveniencia de hacerlo. Sin embargo, siendo tan importante esta obligación generalmente se ha descuidado por casi todos los patrones del mundo. La original fracción XV del artículo] 32 de la Ley de ]970, a la letra decía: "El patrón tiene la obligación de: Organizar permanente o periódicamente cursos o enseñanzas de capacitación pr<strong>of</strong>esional o de adiestramiento para sus trabajadores, de conformidad con los planes y programas que, de común acuerdo elaboren los sindicatos de trabajadores informando de ello a la Secretaria del Trabajo y Previsión Social o a las autoridades del trabajo de los Estados, Territorios y Distrito Federal. Éstos podrán implantarse en cada empresa o para varias en uno O varios establecimientos o departamentos o secciones de las mismas por personal propio o por pr<strong>of</strong>esores técnicos especialmente contratados o por conducto de escuelas o instituciones especializadas o por alguna otra modalidad. Las autoridades del trabajo vigilarán la ejecución de los cursos o enseñanzas." Dicha fracción era tan elástica que se le conocía con el nombre de la fracción de las ]4 alternativas, ya que la misma preveía ]4 distintas posibilidades. Sin embargo, a pesar de las facilidades otorgadas a los patrones para capacitar a sus trabajadores, estos no cumplieron con dicha fracción lo que trajo como consecuencia que se reglamentara la misma en forma detallada por el Diario Oficial de fecha 28 de abril de ]978. El actual articulo] 53-A de la ley de la materia establece que todo trabajador tiene el derecho a que su patrón le proporcione capacitación o adiestramiento en su trabajo, que le permita elevar su nivel de vida y productividad, conforme a los planes y programas formulados de común acuerdo por el patrón y el 184
