only occur within the building footprint area, street right-<strong>of</strong>-way, driveways, utility<br />

easements, and drainage ways after plat or site plan approval is obtained. A tree and<br />

root preservation plan shall be incorporated for these trees. The plan shall consist <strong>of</strong><br />

the following preventative measures:<br />

(a) Tree protection barriers shall be placed around all significant trees to be saved.<br />

These barriers shall be installed prior to grading, construction, or other land<br />

disturbing activity and cannot be removed until after final inspection by the <strong>City</strong>.<br />

The barriers shall be constructed from any material substantial enough to<br />

protect the roots, trunk, and crown <strong>of</strong> the tree, such as 2x4 standards and 1x4<br />

rails, silt fencing or orange silt fencing, a minimum 4 feet in height on metal or<br />

wood posts. The barriers shall be placed at least 1 foot from the tree trunk for<br />

each 1-inch in tree diameter, with a minimum distance <strong>of</strong> 10 feet required from<br />

the edge <strong>of</strong> the trunk.<br />

(b) No soil disturbance or compaction, stock piling <strong>of</strong> soil or other construction<br />

materials, vehicular traffic, storage <strong>of</strong> heavy equipment are allowed in the tree<br />

and root protection area or within the drip line <strong>of</strong> trees to be retained.<br />

(c) Dead trees and undesirable scrub growth shall be cut flush with adjacent grade<br />

and removed during construction. Stumps <strong>of</strong> trees greater than 3 inches in DBH<br />

shall be ground with stump grinder or removed and filled.<br />

Section 12.10. Prohibited Plants<br />

Effective April 20, 2005, it shall be unlawful for any person to sell or plant any<br />

<strong>of</strong> the following prohibited trees and plant material. Any person who sells or plants a<br />

tree or plant material in violation <strong>of</strong> this Section may be required to remove such<br />

prohibited tree or plant at their sole expense.<br />
