(157) NON-COMMERCIAL BOAT DOCK AND NON-COMMERCIAL BOAT LIFT<br />

A non-commercial boat dock is a single boat dock or boat lift that is<br />

privately owned by the owner <strong>of</strong> the upland property and may not be<br />

rented, leased or sold separately to another person or entity. [See<br />

exception in <strong>Chapter</strong> 6-19]<br />

(158) NON-CONFORMING LOT OF RECORD<br />

A lot described by a plat or a deed that was recorded prior to the effective<br />

date <strong>of</strong> these regulations [or their amendments] that does not meet the<br />

minimum lot size or other development requirements <strong>of</strong> this Ordinance.<br />

See Section 17.6.<br />

(159) NON-CONFORMING USES<br />

Any actual and active use lawfully being made <strong>of</strong> any land, building, sign<br />

or structure not otherwise abandoned, which exists on the effective date<br />

<strong>of</strong> this Ordinance or on the effective date <strong>of</strong> any amendment thereto, and<br />

renders such existing use illegal within a district, or which does not<br />

comply in any fashion with any <strong>of</strong> the regulations <strong>of</strong> this ordinance or any<br />

amendments thereto. If the property or structure is vacant or unused on<br />

the effective date <strong>of</strong> this Ordinance or any amendment thereto, it shall be<br />

conclusively presumed that the property or structure is subject to the<br />

provisions <strong>of</strong> this Ordinance or any amendments thereto.<br />

(160) NON-PERMANENT STRUCTURE<br />

Improvements that are easily removed by hand and are not joined<br />

together by any permanent bonding device such as nails, screws or<br />

mortar or by any other permanent bonding method.<br />

(161) NON-RESIDENTIAL DEVELOPMENT<br />

All development other than residential development, agriculture and<br />

silviculture.<br />

(162) OFFICE USE<br />

Pr<strong>of</strong>essional, service, and governmental occupations within a building or<br />

buildings which do not generally involve the on-site sale <strong>of</strong> goods to<br />

customers.<br />

(163) OFF-STREET PARKING<br />

Parking which occurs on a lot and not on a street or other public right <strong>of</strong><br />

way.<br />

(164) ON SITE, OFF SITE<br />

Located on the lot relative to a use, or structure; or located <strong>of</strong>f the lot<br />

relative to a use, or structure.<br />

(165) OPEN DECKS AND PATIOS<br />

Permanent uncovered construction which projects from an existing<br />

principal use.<br />
