Section 8.6. Live-Aboard Boats, Houseboats, and Other Watercraft<br />
Living aboard is prohibited in any district except as provided in the MP zoning<br />
district or within a marina approved by the <strong>City</strong> Council in accordance with the<br />
following procedures and standards. All applications for approval <strong>of</strong> live-aboard<br />
marinas shall be filed with the Urban Design Manager in a form prescribed by the<br />
Manager, accompanied by such plans and specifications as he may require. If upon<br />
preliminary examination <strong>of</strong> the application the Manager finds that the proposed marina<br />
will meet all the requirements <strong>of</strong> this Ordinance, he shall forward the plans to the<br />
Development Review Committee for their approval so that the <strong>City</strong> Clerk shall cause<br />
the matter <strong>of</strong> approval to be set for public hearings by the Planning Commission and<br />
the <strong>City</strong> Council and shall advertise notice there<strong>of</strong> in a newspaper <strong>of</strong> general circulation<br />
within the <strong>City</strong> not less than 15 days before the date set for public hearings by the<br />
Planning Commission and 30 days for the <strong>City</strong> Council.<br />
(a) Upon the holding <strong>of</strong> such hearings, such use may be allowed if it is determined<br />
that the use as proposed will meet all the standards hereinafter set forth and it<br />
is also found that:<br />
(1) The use will not be detrimental to surrounding properties.<br />
(2) The use is suitable in its proposed location.<br />
(3) The use will not operate to the detriment <strong>of</strong> the transportation system<br />
upon consideration <strong>of</strong> access control, traffic generation and road<br />
capacities.<br />
(4) The use will not result in any economic burdens on the public or<br />
demands on utilities, community facilities and public services.<br />
(5) The use complies with the comprehensive plan for the <strong>City</strong>.<br />
(6) The use will not be detrimental to the safety, health, morals or general<br />
welfare <strong>of</strong> the public.<br />
(b) No marina shall be approved for live-aboard use unless it provides:<br />
(1) An adequate, safe and potable supply <strong>of</strong> water shall be provided in<br />
compliance with <strong>Chapter</strong> 17-22, Water Supplies, Florida Administrative<br />
Code. Whenever a municipal or public water supply is available to the<br />
marina, such water supply shall be used. At least one service connection<br />
shall be provided for each slip, consisting <strong>of</strong> at least a water hydrant and<br />
the necessary appurtenances, protected against the hazards <strong>of</strong> backflow<br />
and siphonage.<br />
(2) Not less than the following toilet and bathing facilities contained in<br />
central units for men and women shall be provided in addition to those<br />
required for employees. For women: one toilet seat for each 15 women or<br />
fraction there<strong>of</strong>; one lavatory for each 20 women or fraction there<strong>of</strong>; one<br />
shower bath for each twenty 20 women or fraction there<strong>of</strong>. For men: One<br />
toilet seat for each 20 men or fraction there<strong>of</strong>; one urinal for each 25<br />
men or fraction there<strong>of</strong>; one lavatory for each 20 men or fraction there<strong>of</strong>;<br />
one shower bath for each 20 men or fraction there<strong>of</strong>. All must be<br />
maintained in a clean and sanitary condition at all times. Sinks, urinals<br />
and toilets, as well as floors, must be washed with a suitable cleaning<br />
agent each day. The number <strong>of</strong> men and women shall be estimated on<br />
the basis <strong>of</strong> 3 persons to each slip, the total population to be considered<br />
equally divided as to men and women.<br />
