SAMPLE CONTRACT<br />

8.2 All notifications from COUNTY enclosing an amendment or new or revised<br />

policy, procedure, protocol or exhibit to this Contract shall be sent by Mail.<br />

8.3 All written notification from COUNTY regarding Corrective Action Plan,<br />

Hold, “Do Not Refer” or “Do Not Use” status shall be sent by Certified Mail,<br />

Return Receipt Requested.<br />

9.0 CONFIDENTIALITY<br />

9.1 Pursuant to Welfare <strong>and</strong> Institutions Code, Sections 5328 through 5330,<br />

10850 <strong>and</strong> 827, all Placed <strong>Children</strong>'s records are confidential. Portions <strong>of</strong><br />

these confidential records, pertaining to the treatment or supervision <strong>of</strong> the<br />

child, shall be shared with CONTRACTOR pursuant to the DCFS policy in<br />

effect <strong>and</strong> applicable state <strong>and</strong> federal law. The Juvenile Court has<br />

exclusive jurisdiction over juvenile records, documents <strong>and</strong> case<br />

information as well as the responsibility to maintain their confidentiality <strong>and</strong><br />

the confidentiality <strong>of</strong> dependent children. A child under DCFS’ supervision<br />

may not be videotaped, photographed, voice recorded or interviewed, for<br />

media, research or other purposes, unless the Juvenile Court has issued<br />

an order permitting such access. Anyone requesting to review a Placed<br />

Child's case records, interview a Placed Child for research or media<br />

purposes, or photograph or videotape a Placed Child, must obtain written<br />

approval in accordance with Juvenile Court policy as described in <strong>Los</strong><br />

<strong>Angeles</strong> Superior Court, Local Rules, Chapter 17, Juvenile Division,<br />

Dependency Proceedings, effective May 1, 1999. CONTRACTOR agrees<br />

to maintain the confidentiality <strong>of</strong> its records <strong>and</strong> conform to existing orders<br />

<strong>of</strong> the Juvenile Court <strong>and</strong> policies promulgated by state <strong>and</strong> federal laws<br />

<strong>and</strong> COUNTY Policies regarding the Placed Child's confidentiality<br />

9.2 If CONTRACTOR’s staff qualify as members <strong>of</strong> a multi-disciplinary team,<br />

as defined in WIC Sections 830 <strong>and</strong> 18951(d), such staff may access <strong>and</strong><br />

disclose information regarding children accordingly.<br />

9.3 CONTRACTOR shall maintain the confidentiality <strong>of</strong> all records, including<br />

but not limited to COUNTY records <strong>and</strong> client records, in accordance with<br />

all applicable federal, state <strong>and</strong> local laws, regulations, ordinances <strong>and</strong><br />

directives regarding confidentiality. CONTRACTOR shall inform all <strong>of</strong> its<br />

<strong>of</strong>ficers, employees, agents, <strong>and</strong> Certified Foster Parents providing<br />

services <strong>and</strong> care hereunder <strong>of</strong> the confidentiality provisions <strong>of</strong> this<br />

Contract. All Certified Foster Parents, <strong>and</strong> all employees <strong>of</strong><br />

CONTRACTOR who have access to confidential records <strong>and</strong> data must<br />

sign <strong>and</strong> adhere to the attached “Certified Foster Parent Acknowledgment<br />

<strong>and</strong> Confidentiality Agreement” (Exhibit D) <strong>and</strong>/or the “Contractor<br />

Employee Acknowledgment <strong>and</strong> Confidentiality Agreement Form” (Exhibit<br />

D-I).<br />
