SAMPLE CONTRACT<br />

written in accordance with the Program Statement guidelines <strong>of</strong> CCLD<br />

included in Exhibit A-II, Foster Family Agency (FFA) Program Statement<br />

Instructions, <strong>and</strong> Exhibit A-III, <strong>Los</strong> <strong>Angeles</strong> <strong>County</strong> <strong>Department</strong> <strong>of</strong> <strong>Children</strong><br />

<strong>and</strong> Family Services (DCFS) Amendment to LIC. 9128 (6/99) for Foster<br />

Family Agency Contract Program Statement.<br />

2.42 “Real Property” – means L<strong>and</strong> <strong>and</strong> anything growing on, attached to, or<br />

erected on it.<br />

2.43 “Resource Family” – means a family that is dually trained <strong>and</strong> certified as<br />

both a Certified Foster Home <strong>and</strong> an adoptive home.<br />

2.44 “Service(s)”- means the basic needs the CONTRACTOR agrees to meet<br />

for each Placed Child as outlined in the California <strong>Department</strong> <strong>of</strong> Social<br />

Services Regulations; Statement <strong>of</strong> Work (Exhibit A); <strong>and</strong><br />

CONTRACTOR's Program Statement (Exhibit B).<br />

2.45 “Subcontract” - means a contract by which a third party agrees to provide<br />

services or materials necessary to fulfill an original contract.<br />

2.46 “Subcontractor” – means an organization or individual that enters into a<br />

Contract with CONTRACTOR to provide specific program services. Such<br />

individuals are not considered employees <strong>of</strong> CONTRACTOR or COUNTY.<br />

In foster care, a Subcontractor usually provides hourly or fixed fee services<br />

based on the number <strong>of</strong> Placed <strong>Children</strong> in the program.<br />

2.47 “Team Decision Making or TDM” – is a process utilizing a multi-disciplinary<br />

assessment <strong>and</strong> team approach in working with children <strong>and</strong> their families.<br />

2.48 “Title 22” – means the California Code <strong>of</strong> Regulations for community care<br />

facilities including Foster Family Agencies.<br />

2.49 “Un-Expended Funds” or “un-Expended” - means AFDC-FC funds,<br />

received through this Contract, which are retained <strong>and</strong> not spent by<br />

CONTRACTOR. (See Part I, Section 25.0 Use <strong>of</strong> Funds, Sub-section 25.6<br />

<strong>of</strong> this Contract.)<br />

3.0 TERM<br />

3.1 The term <strong>of</strong> this Contract shall be _______ months, commencing after<br />

execution by the Director <strong>of</strong> DCFS, through the termination date <strong>of</strong> the<br />

current Contract year unless terminated earlier or extended, in whole or in<br />

part, as provided in this Contract.<br />

3.2 The COUNTY shall have the sole option to extend the Contract term for up<br />

to four (4) additional 12-month periods for a maximum total Contract term<br />
