7.14 CONTRACTOR may appeal the final decision pursuant to Part I, Section 19.0,<br />

Dispute Resolution Procedures.<br />

7.15 For overpayments, CONTRACTOR shall submit payment <strong>of</strong> any amounts due<br />

to COUNTY within thirty (30) Days after the Program Director’s/Placement<br />

Bureau Chief <strong>of</strong> his/her designee’s decision, unless CONTRACTOR appeals the<br />

decision pursuant to Section 7.0, in which case collection efforts shall be<br />

suspended until such time as there is final resolution <strong>of</strong> the appeal.<br />

7.16 With regard to overpayments, COUNTY shall be entitled to pre-judgment<br />

interest at the highest rate permitted by law. With regard to underpayments,<br />

CONTRACTOR shall be entitled to pre-judgment interest at the highest rate<br />

permitted by law.<br />

7.17 Provided that COUNTY shall remove all Placed <strong>Children</strong> on or prior to the<br />

expiration or other termination <strong>of</strong> this Contract, CONTRACTOR shall have no<br />

claim against COUNTY for payment <strong>of</strong> any money or reimbursement, <strong>of</strong> any<br />

kind whatsoever, after the expiration or other termination <strong>of</strong> this Contract.<br />

Should CONTRACTOR receive any such payment it shall immediately notify<br />

COUNTY <strong>and</strong> shall immediately repay all such funds to COUNTY. Payment by<br />

COUNTY for Services rendered after expiration/termination <strong>of</strong> this Contract<br />

shall not constitute a waiver <strong>of</strong> COUNTY’s right to recover such payment from<br />

CONTRACTOR. This provision shall survive the expiration or other termination<br />

<strong>of</strong> this Contract. Notwithst<strong>and</strong>ing the foregoing, if COUNTY does not remove a<br />

Placed Child from a group home following termination <strong>of</strong> this Contract,<br />

COUNTY will pay based upon the group home’s RCL rate.<br />

8.0 NOTICES<br />

8.1 Unless otherwise specifically provided in this Contract, all notices to COUNTY<br />

shall be given in writing, sent by certified mail, return receipt requested, by<br />

enclosing the same in a sealed envelope addressed to the intended party <strong>and</strong><br />

by depositing such envelope with postage prepaid in the United States Post<br />

Office or any substation or public letterbox. All notices to COUNTY shall be<br />

sent by certified mail, return receipt requested in duplicate addressed to the<br />

following:<br />
