materially alter any term or condition included in this Contract, or for any<br />

change in CONTRACTOR’s Program Statement, or for any change to<br />

exhibits described in Sub-section 5.1 with significant cost impact on<br />

CONTRACTOR, a change notice shall be prepared by COUNTY, <strong>and</strong><br />

executed by CONTRACTOR <strong>and</strong> Program Directors or designee. As used<br />

herein, the term “materially alter” is defined as being a change, which, in the<br />

sole discretion <strong>of</strong> COUNTY, warrants execution, by the Board <strong>of</strong><br />

Supervisors.<br />

5.3 Except as provided in Part I, Section 3.0, Term, for any change not<br />

covered by Sections 5.1 or 5.2, an amendment to this Contract shall be<br />

prepared, by COUNTY, signed by CONTRACTOR, <strong>and</strong> thereafter<br />

submitted to COUNTY’s Board <strong>of</strong> Supervisors for consideration <strong>and</strong>, if<br />

approved, execution.<br />

6.0 REPORTING SUSPECTED CHILD ABUSE<br />

6.1 CONTRACTOR agrees that the safety <strong>of</strong> the Placed Child will always be<br />

the first priority. To ensure the safety <strong>of</strong> the Placed <strong>Children</strong>,<br />

CONTRACTOR will, <strong>and</strong> CONTRACTOR will train staff to, immediately,<br />

upon discovery, whenever CONTRACTOR reasonably suspects that a<br />

Placed Child has been a victim <strong>of</strong> abuse <strong>and</strong>/or is in danger <strong>of</strong> future<br />

abuse, notify: (1) CCLD <strong>and</strong> the COUNTY’s child protection hotline<br />

(CPHL); (2) for DCFS children, the DCFS Program Manager; <strong>and</strong> (3). For<br />

Probation children, the Regional <strong>and</strong> Central Placement Unit.<br />

CONTRACTOR will remain with the Placed Child if imminent risk is<br />

present. CONTRACTOR <strong>and</strong> CONTRACTOR’s staff shall coordinate with<br />

CCLD, the DCFS Resource Contract Management, <strong>and</strong> the Probation<br />

Central Placement Unit prior to the investigation <strong>of</strong> any allegation <strong>of</strong> child<br />

abuse <strong>and</strong> follow their instructions on how to proceed.<br />

6.2 CONTRACTOR shall ensure that all known or suspected instances <strong>of</strong><br />

child abuse are reported to a child protection agency as defined in Section<br />

11164, et. Seq. <strong>of</strong> the Penal Code. This responsibility shall include:<br />

6.2.1 A requirement that all employees, consultants, or agents<br />

performing services under this Contract who are required by Penal<br />

Code, Section 11166(a), to report child abuse, sign a statement<br />

that he or she knows <strong>of</strong> the reporting requirements <strong>and</strong> will comply<br />

with them.<br />

6.2.2 To the extent possible <strong>and</strong> reasonable, CONTRACTOR will<br />

educate employees, consultants or agents who are not m<strong>and</strong>ated<br />

reporters <strong>of</strong> child abuse, as defined in California Penal Code<br />

Section 11166 et seq, on procedures for reporting any reasonable<br />

suspicion <strong>of</strong> child abuse.<br />
