records may be released to the caregiver if pertinent to maintaining<br />

the health <strong>and</strong> safety <strong>of</strong> the child while in the caregiver's care. With<br />

SCSWs' approval <strong>and</strong> a signed DCFS 4389 on file the portion <strong>of</strong> the<br />

psychological records which discusses the treatment plan <strong>and</strong><br />

goals for the child may be provided to the caregiver pertinent to<br />

maintaining the health <strong>and</strong> safety <strong>of</strong> the child while in the caregiver's<br />

care.<br />

3. Photocopy only the records authorized for release. Review carefully, black-out any<br />

unauthorized information <strong>and</strong> photocopy the initial copy. Release the second copy<br />

<strong>and</strong> ensure that the initial altered copy is shredded.<br />

B. WHEN: A MENTAL HEALTH SERVICE PROVIDER INCLUDING<br />

COURT ORDERED 730 EVALUATORS REQUEST CASE<br />

RECORDS INFORMATION<br />

The CSW shall discuss the mental health needs <strong>of</strong> the child with his/her SCSW <strong>and</strong><br />

complete the required forms. For information regarding the procedure for obtaining a<br />

psychological evaluation, see Procedural Guide 0600-501.05, Psychological Testing <strong>of</strong><br />

DCFS-Supervised <strong>Children</strong>.<br />

NOTE: The <strong>Department</strong> <strong>of</strong> Mental Health is entitled to all case record information.<br />

In order to provide mental health services or a comprehensive psychological<br />

assessment <strong>and</strong> treatment plan for a child, the mental health service provider, may<br />

have access to the child’s psychological records, medical/dental records, school<br />

records, court-ordered visitation plan with family members, as well as family <strong>and</strong><br />

placement histories.<br />

A mental health services provider may not have access to any child abuse reports or<br />

the identity <strong>of</strong> the reporting party, attorney-client privileged information, or any<br />

information regarding unrelated children contained in any case record documentation.<br />

CSW Responsibilities<br />

1. Discuss the child’s needs with the SCSW.<br />

2. Discuss the child’s needs in non-identifying terms with a potential mental health<br />

provider.<br />

3. Obtain a signed DCFS 4389 from the potential mental health service provider if<br />

identifying information is requested <strong>and</strong> from the selected provider before<br />

releasing any requested information. File the DCFS 4389 in the Additional Services<br />

Documentation Folder.
