B] Operation Oasis – A Study Related to Mentally Ill Persons<br />

in West Bengal<br />

12.8 The <strong>Commission</strong> entrusted the Sane and Enthusiast Volunteers’ Association of Calcutta<br />

(SEVAC), a Kolkata based NGO to carry out the ‘Study related to mentally ill persons<br />

languishing in jails, vagrant and juvenile homes of West Bengal’. The duration of the project<br />

was initially for a period of one year for which Rs.3,10,000/- were sanctioned by the<br />

<strong>Commission</strong>.<br />

12.9 The main objective of the study was to identify the percentage of mentally ill and mentally<br />

disabled persons in prisons and other correctional and custodial institutions in West Bengal as<br />

well as assess their overall human rights situation so that arrangements could be made for their<br />

release and restoration.<br />

12.10 The study has been carried out in four jails, namely, Dumdum Central Jail, Presidency<br />

Jail, Alipore Special Jail and Berhampore Central Jail; three Vagrant Homes, namely, Home for<br />

Lunatic Vagrants at Mahalandi, which houses both males and females, Uttarpara Female Vagrant<br />

Home, Dhakuria Male Vagrant Home, and two Rescue Homes, namely, Kishalay Home for<br />

Boys and S.M.M. Home at Liluah for females.<br />

12.11 The study has been completed by SEVAC and its final draft report has also been submitted<br />

to the <strong>Commission</strong>. It is inferred from the report that while care of mentally ill patients remains a<br />

cause of concern; the State Government too was neither discharging its duties and obligations<br />

towards these patients nor complying with the provisions of the Mental Health Act, 1987.<br />

II] On-going Studies<br />

A] Study of the Implementation of the Juvenile Justice<br />

(Care and Protection of Children) Act, 2000<br />

12.12 The <strong>Commission</strong> approved a proposal for undertaking a study of the Implementation of<br />

the Juvenile Justice (Care and Protection of Children) Act, 2000 in February 2004 submitted by<br />

the Socio-Legal Information Centre, New Delhi. The study aims to review the extent of<br />

implementation of the Juvenile Justice (Care and Protection of Children) Act, 2000 by carrying<br />

out the following:-<br />

Interaction with the nodal Government agencies to ascertain the status of the Institutions/<br />

Committees/Boards that ought to be set up under the Act;<br />
