4.85 Vide proceedings dated 20.5.2003, the <strong>Commission</strong> observed as under:<br />
4.86 The <strong>Commission</strong>, therefore, reiterated its recommendations and called upon the State of<br />
Uttar Pradesh to immediately make payment of Rs.20,000/-, as ordered by the <strong>Commission</strong> by<br />
its proceedings dated 3/4/02 April, 2002 and reiterated on 9/9/02.<br />
4.87 In response, the SSP, Bulandshahar vide letter dated 11.2.2004 submitted compliance<br />
report indicating that an amount of Rs.20,000/- had been paid to the victim on 7.11.2003. The<br />
case was therefore, closed.<br />
14. Suicide by Vinod Kumar Rajput due to police harassment Madhya Pradesh<br />
Case No.1412/12/98-99(FC)<br />
4.88 The <strong>Commission</strong> received a complaint dated 22/10/1998 from Mrs. Deepa Rajput alleging<br />
that, while her husband, Vinod Kumar Rajput was returning from the bank to his shop on 30.7.98<br />
alongwith a cash of Rs.2.5 lacs, some miscreants attacked him with a sword and snatched the<br />
entire money from him. Despite lodging a report with the Police, no action was taken to apprehend<br />
the culprits. On the other hand, her husband was repeatedly called by the Police to the Police<br />
station and was tortured by them. As a result, he committed suicide on 6.9.98. She prayed for an<br />
appointment on compassionate grounds and compensation.<br />
4.89 Pursuant to the direction dated 10/03/1999, the State Government of M.P. forwarded a<br />
report of Collector, Bhopal alongwith an enquiry report of the Jt. Collector, Bhopal. The District<br />
Collector, in his report, stated that since the husband of the complainant was not in Government<br />
service, no Government service could be offered to the complainant on compassionate ground<br />
as per the administrative rules. The enquiry report disclosed that Shri Rashid Khan, ASI had<br />
threatened Shri Vinod Kumar of defaming his father and his wife if he did not disclose everything.<br />
Shri Vinod Kumar swallowed two tablets of sulphur on the way, due to which he died in Hameedia<br />
Hospital. This version also finds support from the dying declaration of Vinod. The Inquiry Officer<br />
concluded that the suicide committed by Shri Vinod Kumar was not a result of police action but<br />
due to fear of defamation that may affect his family members. The IO held ASI Rashid Khan<br />
guilty of threatening Shri Vinod Kumar and recommended departmental action against him.<br />
4.90 The <strong>Commission</strong> considered the afore mentioned reports on 30/08/2001 and held that the<br />
deceased was forced to commit suicide due to the threat of the ASI. Accordingly, it issued showcause<br />
notice to the State Government u/s 18(3) of the Protection of <strong>Human</strong> <strong>Rights</strong> Act, 1993 to<br />
show cause as to why compensation of Rs.1 lakh be not awarded to the complainant<br />
4.91 In reply to the above show cause notice, the State Government of Madhya Pradesh, vide<br />
letter dated 7/8/2002, submitted that necessary instructions were issued by the SP Bhopal to<br />
recover an amount of Rs. 50,000/- @ Rs. 2,000/- per month from the salary of the guilty police<br />
