4. Atrocities on inmates by the Superintendent of Probation Home : Jharkhand<br />

(Case No. 177/34/2001-2002)<br />

4.247 This case was earlier reported in the <strong>Annual</strong> <strong>Report</strong> for the year 2002-2003. The<br />

<strong>Commission</strong> received a complaint dated 6.05.01 from Kumari Sita alleging mal-administration<br />

in the Probation Home, Devghar where girls were lodged. It was alleged that the girls were not<br />

being looked after properly and that they were being deprived of food, clothing and medicines.<br />

As a result, a girl inmate reportedly died on 02.02.01. The complaint also alleged that during<br />

April 2001, some of the inmates were beaten by the staff of the Probation Home and that, as a<br />

result, one of the girls had escaped from the Home.<br />

4.248 Having regard to the serious mal-administration in the probation home and the resultant<br />

violation of human rights of the inmates pointed out in the report received by the <strong>Commission</strong>,<br />

the <strong>Commission</strong> issued notice to the Chief Secretary, Government of Jharkhand, asking him<br />

to show cause as to why immediate interim relief be not granted to the inmates named in<br />

the report.<br />

4.249 Response from the Government of Jharkhand is, however, still awaited.<br />

5. Exploitation of child labourers in Tonk: Rajasthan (Case No. 817/20/2001-2002 )<br />

4.250 This case relating to violation of Sec. 3 of the Child Labour (Prohibition & Regulation)<br />

Act. 1989 was earlier reported in the <strong>Annual</strong> <strong>Report</strong> for the year 2002-2003. Having regard to<br />

the employment of a number of child labourers by the accused in contravention of the provisions<br />

of Section 3 of the Child Labour (Prohibition & Regulation) Act, 1989 and the institution of<br />

cases in the court against the offending employer, by its proceedings dated 02.05.02 the<br />

<strong>Commission</strong> directed the District Magistrate, Tonk, Rajasthan to prepare a list of child labourers<br />

who were employed by carpet weaving unit and to recover a sum of Rs. 20,000/- per child from<br />

the offending employer, and to deposit that sum in a fund to be known as the Child Labour<br />

Rehabilitation cum Welfare Fund. The State Government was also directed to contribute<br />

Rs. 5,000/- per child to the said fund in accordance with the directions of the Apex Court.<br />

4.251 The District Collector, Tonk submitted a report indicating that 11 cases were pending in<br />

respect of the 37 child labourers and notices for recovery of Rupees Twenty Thousand per child<br />

labour had been issued to the employer. The <strong>Commission</strong> vide its proceedings dated 29.6.05<br />

directed the DM to furnish latest status report of recovery of Rs. 20,000/- per child labour from<br />

the defaulting employer. The requisite report is still awaited.<br />
