4.223 On the basis of a report received from the Superintendent of Police, Tiruchirapalli<br />

confirmed that the complainant’s husband Manoharan was unlawfully arrested by the Deputy<br />

Superintendent of Police, Jayashree and Constable G. Rajasekaran and detained at the police<br />

station, Tiruchirapalli without any valid reason, the <strong>Commission</strong> directed the State Government<br />

of Tamil Nadu to pay a sum of Rs.50,000/- as immediate interim relief to Manoharan and initiate<br />

a departmental enquiry against erring police officials for his wrongful confinement.<br />

4.224 While the amount of interim relief was paid to the victim and proof of payments submitted<br />

to the <strong>Commission</strong>, disciplinary action initiated against the errant police personnel was<br />

under process.<br />

2. Illegal detention and torture in police Station, Shikarpur: Uttar Pradesh<br />

(Case No. 17171/24/1999-2000)<br />

4.225 This case relating to illegal detention and torture of Prahlad Swaroop and Satish was<br />

earlier reported in the <strong>Annual</strong> <strong>Report</strong> for the year 2003-2004. Upon consideration of the<br />

enquiry report submitted by Additional Superintendent of Police, District Khurja that the<br />

allegations of illegal detention and torture stood substantiated, the <strong>Commission</strong> awarded a<br />

sum of Rs.10,000/- as interim relief to each of the two victims viz. Prahlad Swaroop and<br />

Satish. As the Government of UP paid the amount through cheque on 23.9.2004, the case<br />

was closed.<br />

3. Police high-handedness against a teacher in Kota : Rajasthan Case No: 1603/<br />

202001-2002)<br />

4.226 This case relating to illegal detention of Prem Chand was earlier reported in the <strong>Annual</strong><br />

<strong>Report</strong> for the year 2002-2003. The <strong>Commission</strong> vide its proceedings dated 14-2-2003, held<br />

that the complainant was kept under illegal detention and accordingly it issued a show cause<br />

notice u/s 18(3) of the Protection of <strong>Human</strong> <strong>Rights</strong> Act. 1993 to the State of Rajasthan. While<br />

the matter rested thus, the <strong>Commission</strong> was informed that a case had been registered against<br />

the erring SI, and on the basis of the report received from the State <strong>Human</strong> <strong>Rights</strong> <strong>Commission</strong><br />

disciplinary proceedings were initiated against him and he had been censured. The matter<br />

relating to grant of interim relief was also under consideration by the State <strong>Human</strong> <strong>Rights</strong><br />

<strong>Commission</strong>. As the State <strong>Human</strong> <strong>Rights</strong> <strong>Commission</strong> was already seized of the matter, the<br />

case was closed.<br />

4. Negligence of police personnel leading to wrongful confinement of Ikram-ud-din:<br />

Uttar Pradesh (Case No. 23239/24/1999-2000)<br />

4.227 This case relating to wrongful confinement of Mr. Ikram-u-din was earlier reported in<br />

the <strong>Annual</strong> <strong>Report</strong> for the year 2002-2003. The <strong>Commission</strong> vide its proceedings dated 11.10.02<br />
