on account of the proposed construction of a barrage across the river Nagavalli near Thotapalli<br />
village of Vizianagaram District in Andhra Pradesh. According to the complaint, a large number<br />
of farmers who are dependent upon the present regulator for irrigation would be seriously affected.<br />
Besides, the agricultural labourers would also lose their jobs.<br />
4.145 Having regard to the likely effect on the right to shelter, food and work of hundreds of<br />
farmers, the <strong>Commission</strong> called for a factual report from the Chief Secretary, Government of<br />
Andhra Pradesh and directed him to inform the <strong>Commission</strong> whether there was any relief and<br />
rehabilitation (R&R) package proposed for the persons who would be affected, and the nature<br />
of the relief and rehabilitation package.<br />
4.146 In response, the State Government of Andhra Pradesh submitted a report vide letter<br />
dated 27-8-2003 giving details of relief and rehabilitation programme to be undertaken in<br />
respect of displaced persons or those who would lose their land in the project. The report<br />
stated that the total number of affected persons who were required to be resettled worked out<br />
to 3287 families and the total amount required for relief and rehabilitation package was Rupees<br />
92.79 crores. The report, however, did not indicate the time frame within which the<br />
relief and rehabilitation programme would be implemented. A detailed report relating<br />
to relief and rehabilitation package proposed by the State Government for the displaced is<br />
still awaited.<br />
25. Rehabilitation and Resettlement of tribals : Karnataka - Case No: 505/10/97-98(FC)<br />
4.147 The <strong>Commission</strong> received a complaint from Shri G. Mohan of Swami Vivekananda<br />
Youth Movement, Karnataka in respect of the rehabilitation and resettlement of the tribals of<br />
H.D. Kote Taluk District, Mysore, Karnataka who were affected by the construction of the<br />
Kabini Reservoir in early 1970s and the formation of Bandipur Project Tiger <strong>National</strong> Park<br />
in 1973-74.<br />
4.148 The <strong>Commission</strong> on 13-01-03, deliberated upon the issue of earmarking<br />
suitable land for rehabilitation of the displaced 154 tribal families and directed the<br />
State Government of Karnataka to send a formal proposal for diversion of forest<br />
land for rehabilitation purpose to the Union Ministry of Forest & Environment for its<br />
approval. The <strong>Commission</strong> also found it appropriate that, in order to facilitate a speedy<br />
and proper rehabilitation of the displaced tribal families, the process of rehabilitation be<br />
monitored by a Committee.<br />
4.149 In response, the State Government accorded necessary sanction for diversion of 200<br />
hectres of forest land in favour of the Revenue Department for rehabilitation of 154 tribal<br />
families displaced by the formation of Bandipur <strong>National</strong> Park and construction of the Kabini<br />
Reservoir in Mysore District. It also constituted a Committee with Shri Chaman Lal, Special<br />
<strong>National</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Commission</strong> <strong>Annual</strong> <strong>Report</strong> - 2004-2005<br />
