are handicapped. During this research, it was found that children are maimed or disfigured and<br />

trafficked for activities like begging. Mentally challenged girls are easy targets for exploitation.<br />

The law should not only provide stringent punishment for the violators, but also shift the onus of<br />

defense on the accused.<br />

Guidelines<br />

The law should also mandate that the government brings out specific guidelines regarding tourism,<br />

hoteliering, and other similar businesses as well as protocols to certain cyber sex, so as to ensure<br />

that women and children are not subjected to commercial sexual exploitation and sex tourism.<br />

The focus should be on involving the community in implementing the rights of women and<br />

children.<br />

Preamble<br />

The preamble to the ITPA should incorporate in itself the philosophy, purpose and orientation of<br />

upholding the rights of women and children. There should be a specific section in the Act containing<br />

a statement of principles, which must emphasise the social philosophy and orientation of the<br />

law, with specific focus on women’s rights and child rights.<br />
