Recommendations of Regional Public Hearings on Right to<br />

Health Care and <strong>National</strong> Action Plan<br />

D.O.No. 11/21/2003-PRP&P 11 March 2005<br />

Dear<br />

1. The <strong>Commission</strong>, in partnership with the Jan Swasthya Abhiyan (JSA), held five Public<br />

Hearings in various regions of the country followed by one Public Hearing at the <strong>National</strong> level<br />

on Right to Health Care. In the Regional Hearings, a large number of individual victims testified<br />

before a panel comprising of senior officials of NHRC, State Government officials and<br />

representatives of JSA. During these hearings, an attempt has been made to identify systemic<br />

gaps in the health care delivery system. The recommendations arising out of the Regional Hearing<br />

pertaining to your State are enclosed.<br />

2. The <strong>National</strong> Public Hearing on Right to Health Care was organized on 16-17 December<br />

2004 at New Delhi. In the two day hearing, there were discussions on issues like women’s right<br />

to health care, children’s right to health care, health rights in situations of conflict and displacement,<br />

mental health rights, right to essential drugs, health rights in the context of private medical sector,<br />

occupational and environmental health rights and health rights in the context of HIV/AIDS.<br />

Systemic gaps in health care delivery system were discussed during the <strong>National</strong> Hearing and a<br />

<strong>National</strong> Action Plan to operationalise the Right to Health Care was evolved during the<br />

deliberations (copy enclosed).<br />

3. The recommendations of the Regional Public Hearings and the <strong>National</strong> Action Plan were<br />

examined by the <strong>Commission</strong>. The <strong>Commission</strong> desired that they be forwarded to authorities<br />

concerned for their consideration and to get their feedback thereon by 30 th March 2005. The<br />

feed-back would then be an important input before <strong>Commission</strong> finalizes the recommendations.<br />

4. I, therefore, request you kindly to have a report sent to the <strong>Commission</strong> in this regard. With<br />
