2. Death of Sanjay Sharma in District Jail, Mathura: Uttar Pradesh<br />

(Case No: 41373/24/2000-2001-CD)<br />

4.203 This case relating to death of under trial prisoner, Mr. Sanjay Sharma, was earlier reported<br />

in the <strong>Annual</strong> <strong>Report</strong> for the year 2003-2004.<br />

4.204 Upon consideration of the response to the show cause notice received from the Governement<br />

of UP, the <strong>Commission</strong> held that there had been prima facie violation of human rights relating to<br />

the life of the deceased and recommended (i) grant of interim relief of Rs.50,000/- and also called<br />

for status of disciplinary proceedings already initiated against the concerned officials.<br />

4.205 The State Government of UP informed the <strong>Commission</strong> that the amount of interim relief<br />

had been paid to the mother of the deceased. The State Government submitted proof of payment<br />

and also informed that disciplinary action had been taken against the guilty medical officer Dr.<br />

A. K. Yadav and SI, Deshpal Singh. The matter was accordingly closed.<br />

3. Death of an under-trial prisoner, Tachi Kaki : Arunachal Pradesh<br />

(Case No. 14/2/2002-2003-CD)<br />

4.206 This case relating to death of an under trial prisoner in police firing was earlier reported<br />

in the <strong>Annual</strong> <strong>Report</strong> for the year 2003-2004.<br />

4.207 Agreeing with the opinion of the Judicial Magistrate that the escape of the under trial<br />

prisoner was preventable, and there was no necessity to fire at him by the accused ASI, A.<br />

Bharali, it held that human rights of the accused were violated by the police personnel, and<br />

issued a show cause notice u/s 18(3) of the Protection of <strong>Human</strong> <strong>Rights</strong> Act. 1993 to the Chief<br />

Secretary, Government of Arunachal Pradesh.<br />

4.208 The Joint Secretary (Home) Government of Arunachal Pradesh informed the <strong>Commission</strong><br />

vide its letter dated 11-10-2004 that a payment of Rs. 50,000/- has been paid to the next of kin<br />

of the deceased. The <strong>Commission</strong> took the report on record and closed the case.<br />

4. Custodial death of under-trial prisoner, Harjinder alias Jinda, due to negligence:<br />

Uttar Pradesh (Case No. 8437/24/1999-2000-CD<br />

4.209 This case of the death of an under-trial prisoner was earlier reported in the <strong>Annual</strong> <strong>Report</strong><br />

for the year 2002-2003.<br />

4.210 On consideration of various reports, the <strong>Commission</strong> held that Mr. Harjinder had died in<br />

judicial custody due to negligence and callousness on the part of police personnel, and<br />

recommended a sum of Rs. 1,00,000 as immediate interim relief to the next of kin of the deceased.<br />
