4. Prisoner shot and injured in police lock-up due to negligence by Police, Uttar Pradesh<br />
Case No.6454/24/97-98/6811/24/97-98<br />
4.40 The <strong>Commission</strong> received a complaint from Shri Rajesh Saini, resident of District<br />
Muzaffarnagar, Uttar Pradesh alleging that on 28 th August, 1996 he was taken away from his<br />
house by the police of Kotwali Shamli, U.P. District Muzaffarnagar to the police station where<br />
he was abused, beaten up and tortured. On the next day, two young persons, namely Lokender<br />
and Dilbagh were brought by the police and kept in the same cell. After sometime, Dilbagh fired<br />
at him, as a result of which he received injuries but the police did not take any steps to save him.<br />
4.41 The <strong>Commission</strong> by its proceeding dated 6.12.2001, came to the conclusion that, due to<br />
the negligence of S.O. and the concerned Head Constable, Dilbagh Singh gained access to the<br />
service revolver with which he fired at the complainant, Rajesh Saini and injured him. The<br />
<strong>Commission</strong>, therefore, directed issuance of notice to the Chief Secretary, State Government of<br />
U.P. to show-cause why ‘immediate interim relief’ of Rupees One lakh u/s 18(3) of the Protection<br />
of <strong>Human</strong> <strong>Rights</strong> Act, 1993 not be given to the complainant.<br />
4.42 Upon consideration of the reply from SSP, Muzaffarnagar to the show cause notice, the<br />
<strong>Commission</strong> on 25.5.04, directed the State Government of U.P. to pay a sum of Rs. 1 lakh as<br />
immediate interim relief to victim, Shri Rajesh Saini. The Compliance report from the State<br />
Government is awaited.<br />
5. Death of Shri Bajrang Lal, District Bhiwani, Haryana - Case No. 440/7/97-98/FC<br />
4.43 The <strong>Commission</strong> received a complaint dated 2.07.1998 from Shri Mahesh Kumar resident<br />
of District Bhiwani, Haryana alleging that his brother Bajrang Lal, who was travelling by Mumbai<br />
Janta Express on 26.6.1998 was allegedly beaten up to death by daily passengers. It was further<br />
alleged that the Government Railway Police on duty did not take care and he was not provided<br />
with any medical aid, rather they dumped him in the same compartment on his reserved berth.<br />
One passenger Shri Balwan Singh who witnessed the incident informed the TT on duty who<br />
did not take any action. As a result, by the time the train reached Bharatpur, Rajasthan, his<br />
brother Bajrang Lal had died. The railway police took out the dead body.<br />
4.44 In response to the notice, a report submitted by the DIG, Railway & Commando, Haryana<br />
indicated that the death of Bajrang Lal was caused due to the head injury inflicted by the daily<br />
passengers and sheer negligence of GRP personnel in not providing him timely medical help.<br />
4.45 The <strong>Commission</strong> vide its proceedings dated 5.6.2002 considered the report and directed<br />
the Chairman, Railway Board and Chief Secretary and DGP, Haryana to show cause u/s 18(3)<br />
of the Protection of <strong>Human</strong> <strong>Rights</strong> Act, 1993, as to why an ‘immediate interim relief’ should not<br />
be granted to the next of kin of the deceased.<br />
