Mr. Haeg cannot understand how Mr. Leaders can now claim that the issue <strong>of</strong> whether he was<br />

governed by predator control regulations or hunting regulations is now a legal issue rater than a<br />

factual issue when in response to my motion for dismissal Mr. Leaders stated “the mere fact that<br />

the defendant could have been charged under AS 16.05.783 does not preclude the <strong>State</strong> from<br />

proceeding under AS 8.54.720. The issue <strong>of</strong> whether the defendant killed the wolves in question<br />

under the authority <strong>of</strong> the predator control permit is a factual issue to be left up to the trier <strong>of</strong><br />

fact and is not a basis for pretrial disposition <strong>of</strong> this case.”<br />

Mr. Haeg cannot understand how you can strike down his motion on the basis it is a factual<br />

issue for the jury to decide and then even consider granting Mr. Leaders motion on the basis it is<br />

now a legal issue not for the jury to decide.<br />

Mr. Haeg again requests Mr. Leaders current motion and your response to be in writing.<br />

attorney Brent Cole and with the intention <strong>of</strong> flying to McGrath at 8:00 am November 9 th to<br />

execute the Rule 11 agreement between Mr. Haeg and Mr. Leaders<br />
