negotiations.<br />

MR. ROM: Right and are you aware that Mr. Haeg –uh- that that information was filed<br />

because Mr. Haeg insisted on going into open sentencing against his attorneys advice<br />

MR. OSTERMAN: -Um- there was the issue <strong>of</strong> open sentencing but that was on a plea beyond<br />

the initial rule 11 agreement.<br />

MR. ROM: Correct and that...<br />

MR. OSTERMAN: The initial rule 11 agreement I had heard had been accepted and then Scot<br />

filed an amended information that alleged new material that was –uhreceived<br />

out <strong>of</strong> the rule 11 negotiations.<br />

MR. ROM: And –uh- nobody ever informed you that the reason that<br />

happened is that Mr. Haeg insisted on going into open sentencing which<br />

could have given him a 5 year license suspension – exposure<br />

MR. OSTERMAN: –Uh- again I – I look back I don't agree with that<br />

particular statement. My recollection <strong>of</strong> this particular file –uh- is that -um- Mr. Haeg -<br />

um- had agreed to take a - a – a plea agreement that was initially <strong>of</strong>fered that upon accepting the<br />

plea agreement Mr. Leaders filed an amended information and the amended information<br />

included additional information and then suddenly the rule 11 agreement was – the<br />

(indecipherable) everything was turned <strong>of</strong>f.<br />

MR. ROM: And you weren't aware that the second amended information had significantly<br />

higher penalties statutes attributed to it<br />

MR. OSTERMAN: I – I do know that that was the case and that's one <strong>of</strong> the things that<br />

concerned me is that the first rule 11 agreement got - got the information that<br />

was used to be charged in the second amended information. It seemed<br />

to me that that was –uh- there were several severe problems there.<br />

MAGISTRATE WOODMANCY: Ok...<br />
