Robinson: Listen what I’m saying is that what a lawyer reasonably would be<br />

required to do is that if there really was a deal and at the last minute the<br />

<strong>State</strong> says “oh we don’t want to go through with the deal” then he should<br />

stand up and tell the court I thought we had a deal and this is what the<br />

deal was.<br />

Haeg: Ok let me ask one question. Is an attorney – when it’s proven that an<br />

attorney lies directly to his client is that Ineffective Assistance <strong>of</strong><br />

Counsel And I want it on the tape.<br />

Robinson: That and in amongst itself may not be Ineffective<br />

Assistance <strong>of</strong> Counsel.<br />

Haeg: So you’re telling me you’re lying to me right now<br />

Robinson: No I’m not lying to you about anything.<br />

Haeg: How do I know if you’re not precluded from lying to me Tell me that.<br />

Robinson: Ineffective Assistance <strong>of</strong> Counsel has to do with at a certain level <strong>of</strong> competence that<br />

deals with defending you in a criminal case.<br />

Haeg: I have it right here.<br />

Robinson: It deals with competency it doesn’t deal with honesty it deals with competency. So<br />

the question is whether or not a certain level <strong>of</strong> competency was afforded to you as a client in a<br />

criminal case.<br />

Haeg: How can I get any competence from you if you can lie to me<br />

Robinson: I guess...<br />
