in the Second Amended Information" yet in fact he failed to do so This reinforces the idea the<br />

information was not made on his "<strong>of</strong>ficial oath".<br />

Appeal Notes dated August 18, 2005<br />

Dear Chuck,<br />

I very much would like to have this included in our appeal. I strongly feel we should start<br />

bringing out how poorly I’ve been treated by the <strong>State</strong> and I do feel that this is a legitimate basis<br />

for appeal. The one weak item I can see is that we never did assert our right or privilege to go to<br />

open sentencing before going to trial. Yet if you follow through with my line <strong>of</strong> reasoning we<br />

were indeed penalized for trying to assert our right or privilege. In a way I think it is much like<br />

how you can be penalized for actually committing a crime or attempting to commit a crime. I<br />

would almost like to include the hardships that have followed since Mr. Leaders changed<br />

charges: going to trial, being convicted <strong>of</strong> the harsher charges, wear and tear on me and my<br />

family, all the expenses, etc, etc… I don’t know if this could possibly be included in your appeal<br />

but as I said I would like to see it added if you think it has any merit what so ever. I also<br />

understand that the annotations are not the actual part <strong>of</strong> the Constitution but they must have a<br />

valid standing in fact somewhere. I even think that it would be nice to include<br />

just how many <strong>of</strong> the <strong>State</strong>s requirements that we fulfilled before the<br />

<strong>State</strong> changed the deal. Such as giving them a map pointing out the wolf<br />

kill sites, my & Tony’s interview with the <strong>State</strong>, and canceling my first<br />

years hunts. Thanks again.<br />
