Mr. Osterman: Well why do you think that is<br />

Mr. Haeg: Cause I think if it was in there old Brent Cole and Chuck Robinson they'd be -uhflipping<br />

hamburgers after they got out <strong>of</strong> the ****** Federal pen.<br />

Mr. Osterman: Well I got news for you that aint goanna happen here,<br />

you're not goanna get that to happen here, and I'm not goanna get that to<br />

happen here.<br />

Mr. Haeg: Well you don't know me very well do you<br />

Mr. Osterman: If – if the things you had told me had been true, ok Or<br />

that I could sufficiently document to raise as an issue we would do so. But a lot <strong>of</strong> the things that<br />

you neglected to tell me, including the fact that you testified at trial and confessed to an awful lot<br />

<strong>of</strong> the criminal activity, ok is a serious problem here. We did go back in and we did find that<br />

there may be a reference to a ca[se]– to a -um- the -uh- Courts advisement <strong>of</strong> your rights that<br />

may becoming a big issue and I'm – I'm trying to find that issue. We're also missing I think a<br />

tape and we need to verify that missing tape with you because there is an important Appellate<br />

issue were the Courts required to advise you that you have a right to testify or not to testify and<br />

that the entire right is yours and I can't make you, and defense attorneys can't make you, and<br />

prosecutors can't make you, and judges cannot make you testify. And that rule must be read or<br />

the case is automatically reversible.<br />

Mr. Haeg: you know I remember the Judge telling me that.<br />
