OSTERMAN: Because lets face it the evidence arising out <strong>of</strong> the ineffective assistance<br />

<strong>of</strong> counsel...<br />

HAEG: Ok.<br />

OSTERMAN... is fueling all <strong>of</strong> the complaints from that point on ...<br />

HAEG: Ok yep I agree<br />

OSTERMAN: The Court <strong>of</strong> Appeals can go back to that point.<br />

HAEG: Ok I didn't – I was never told that. Because I don't know what I was told that<br />

was lies and what was true. Now...<br />

OSTERMAN: There's a lot <strong>of</strong> dickering going on I mean I did not make any phone calls<br />

to Chuck.<br />

HAEG: Ok.<br />

OSTERMAN: I did not identify Chuck as a being a problem.<br />

HAEG: He's a big problem – he's a major problem.<br />

OSTERMAN: Ok well – I mean I didn't identify Chuck as being a problem to the people<br />

that I've talked to. They don't know who the attorneys are in this case.<br />

HAEG: But see then you can pull in that stuff and put it back into the Court <strong>of</strong> Appeals<br />

before they look at it. Because right now the Court <strong>of</strong> Appeals doesn't have the – the really bad<br />

stuff because Chuck Robinson kept it out <strong>of</strong> the trial. He fought tooth and nail like Brent Cole –<br />

he told me David don't you dare bring up that you had a Rule 11 Agreement and - and Brent<br />

Cole and – and –uh- Scot Leaders screwed you out <strong>of</strong> it. He said don't bring it up. I said why He<br />

said it'll hurt – hurt my deal that you're goanna win on appeal. We might have to appeal all the<br />

way to the US Supreme Court and that's the information Scot Leaders filed wasn't sworn to. Well<br />

the last time that was upheld was 1906.<br />

OSTERMAN: Over a whiskey bottle.<br />

HAEG: Over a whisky bottle now when I'm betting my life and the way I put food in my<br />

family's mouth and I went ...How much paperwork did I read and you print on Chuck's thing<br />

I'm talking stacks like that. And I came to him and I said, "Do you mean you're – you're goanna<br />

run me to the US Supreme Court and the last time it was won was in 1906" And he's like "well<br />

we may win". I'm like – this is why I started getting scared <strong>of</strong> old Chuck Robinson.<br />
