MR. HAEG: Ok <strong>of</strong> who – <strong>of</strong> who<br />

JACKIE HAEG: Of -um- Brent Cole.<br />

MR. HAEG: Ok. Did he say anything about Chuck Robinson<br />

JACKIE HAEG: Well he said that yeah that Chuck could be brought in with ineffective<br />

assistance <strong>of</strong> counsel also.<br />

MR. HAEG: Ok and was he – did Mr. Osterman seem like it was a good chance, a little chance,<br />

or what – how did he describe the conduct <strong>of</strong> my first two attorneys<br />

JACKIE HAEG: Pretty much as outrageous, unbelievable, you know he couldn't believe what<br />

they had done – or had not done.<br />

MR. HAEG: Ok and did he feel that a lot <strong>of</strong> what they had done or had not done was<br />

attributable to the <strong>State</strong> prosecutor<br />

JACKIE HAEG: Yeah he did. He felt that Mr. Leaders had done quit a bit <strong>of</strong> things bad in<br />

your case.<br />

MR. HAEG: And that – and was my attorneys actions in – or inactions a result <strong>of</strong> what Mr.<br />

Leaders did<br />

JACKIE HAEG: In breaking the rule 11 agreement yes. They – they never stood up for it.<br />

MR. HAEG: Ok and what about the using my statements against me that I made in plea<br />

negotiations – did Mr. Leaders do that and did –uh- Mr. Osterman consider that a very<br />

significant act<br />

JACKIE HAEG: Yes. Mr. Leaders could do that and Mr. Osterman said that he could not<br />

believe that<br />

MR. HAEG: Ok did I ask Mr. Osterman if he had any compunction whatsoever for using the<br />

acts <strong>of</strong> my first two attorneys to help me<br />

JACKIE HAEG: Yes you did ask him that.<br />

MR. HAEG: Ok. So how did – what did – what frame <strong>of</strong> mind did Mr. Osterman try to put me<br />

into – or what – what was his –uh- outlook on the ability <strong>of</strong> us – <strong>of</strong> him to successfully reverse<br />

my conviction<br />

MR. ROM: Objection.<br />

MAGISTRATE WOODMANCY: Sustained. Your asking your wife what he was thinking.<br />

MR. HAEG: Ok. Ok and ok -um- was Mr. Osterman optimistic<br />
