get that in writing.<br />

Haeg: Ok<br />

Robinson: If the client agrees to do it get that in writing. Just say that this is just – you know this<br />

is – we’re making this agreement here that we’re goanna do this.<br />

Haeg: Yep and most other attorneys that you know <strong>of</strong> would follow the same approach<br />

Robinson: That’s a reasonable approach to follow.<br />

Stoumbaugh: Dave seems to think that since – uh - Brent Cole had made this deal with the <strong>State</strong><br />

and then he didn’t get anything in writing that - that was a definite clear-cut case <strong>of</strong> ineffective<br />

counsel. I’m mean he actually just pretty much said “here - here’s Dave’s hide, take it”.<br />

Haeg: And do you Chuck – do you – do you know what ineffective assistance <strong>of</strong> counsel<br />

means<br />

Robinson: I just want to know whether you’re dissatisfied with anything that I’ve done<br />

Because if you are we need to get that out on the table now.<br />

Haeg: Um – have you ever heard <strong>of</strong> ineffective assistance <strong>of</strong> counsel<br />

Robinson: Yes I know what ineffective assistance <strong>of</strong> counsel is – I represent people...<br />

Haeg: Do you think that there would be any case against Brent Cole for ineffective assistance <strong>of</strong><br />

counsel<br />

Robinson: On what issue<br />

Haeg: Him giving – having me – telling me that it was virtually mandatory to give the <strong>State</strong> a 5-<br />

hour interview and maps and having nothing in writing. What do you think about that<br />

Robinson: Having nothing in writing as to what you were going to get in exchange for that<br />

Haeg: Exchange or anything in writing whatsoever for anything.<br />

Robinson: Well that you were not going to get something in exchange for it or – or what David<br />

I’m not quite sure I understand where you’re going. Well here’s the problem is that I wasn’t<br />

there...Scot’s position is “I didn’t back out <strong>of</strong> a deal. David Haeg backed out <strong>of</strong> the deal”.<br />

Stoumbaugh: His point here...<br />

Haeg: Ok – ok<br />
