HAEG: Oh I think I got merit. I think I got constitutional right to effective assistance <strong>of</strong><br />

counsel.<br />

OSTERMAN: You do. And you did not receive effective assistance <strong>of</strong> counsel.<br />

HAEG: And why won’t that reverse my conviction<br />

OSTERMAN: Listen what Cole said is not the issue. What Cole did is always the issue.<br />

HAEG: Yeah he deni[ed] – he did – he denied me my constitutional rights to uphold that deal<br />

and he lied to me about when he found out to cover-up what was going on. And he just… And<br />

then he never even squeaked about them using all <strong>of</strong> my statements to file all these charges.<br />

Chuck Robinson could have used Brent Cole’s ineffectiveness. It’s so glaringly obvious that…<br />

And you may be you are correct when you told me that the Court <strong>of</strong> Appeals is goanna throw my<br />

case out if I go after Brent Cole and Chuck Robinson. You may be correct but you know what<br />

the Court <strong>of</strong> – the <strong>Alaska</strong> Court <strong>of</strong> Appeals is not my last court – my last court that I’ll be seeing<br />

is it<br />

OSTERMAN: That’s correct.<br />

HAEG: Just – how that bear on the rest <strong>of</strong> it Read the rest <strong>of</strong> it.<br />

OSTERMAN: Ok. “The statement <strong>of</strong> the law is always true. The statements inadmissible<br />

if made at any point during the discussions in which the defendant seeks to obtain concessions<br />

from the government in return for plea, plea bargaining is to be evaluated according to the<br />

standard <strong>of</strong> ‘caveat prosecutor”.<br />

HAEG: And what’s that mean<br />

OSTERMAN: Caveat means beware. So beware Mr. Prosecutor. If you <strong>of</strong>fer a deal you<br />

better beware.<br />

HAEG: And what – so like when I was <strong>of</strong>fered a deal why didn’t he have to beware Or<br />

why didn’t he ever get his tit caught in a wringer<br />
