you can prove a conflict <strong>of</strong> interest you do not have to prove prejudice because the likelihood <strong>of</strong><br />

prejudice is so overwhelming that you do not have to prove it. Well whose loyalties did I have<br />

when Mr. Osterman after telling me all <strong>of</strong> the bad things my attorneys did refuse to put it into my<br />

brief and told me he couldn't do so because it would "affect the lives and livelihoods" <strong>of</strong> my<br />

attorneys I hired someone to look out for my life and livelihood and if someone else's actions<br />

when I hired them to represent me and they did it so badly that I got placed in a horrible hole and<br />

it was their conduct but the only way for me to be leveraged out <strong>of</strong> my hole to justice and a fair<br />

trial is to affect their lives and livelihood so be it. It isn't my responsibility to accept the damage<br />

<strong>of</strong> my attorneys who committed such horrible things against me. They have to take – be<br />

responsible for what they did against me. And Mark Osterman said he was not willing to show<br />

what my attorneys did that robbed me <strong>of</strong> my right to a fair trial – he was not willing to show the<br />

court that and that is one <strong>of</strong> the most egregious things that has ever happened in the history <strong>of</strong> the<br />

United <strong>State</strong>s.<br />

MR. ROM: Did you tape record conversations with Mr. Osterman<br />

MR. HAEG: Yes.<br />

MR. ROM: -Um- all <strong>of</strong> them<br />

MR. HAEG: Yes.<br />

MR. ROM: From the very beginning<br />

MR. HAEG: I believe so.<br />

MR. ROM: You talked about the Strickland and Risher test. Do you know what the Risher test<br />

is<br />

MR. HAEG: Yes.<br />

MR. ROM: What is it<br />

MR. HAEG: It is the test to determine whether you have a valid ineffective assistance <strong>of</strong><br />

counsel claim.<br />

MR. ROM: What conflict <strong>of</strong> interest did Osterman have<br />

MR. HAEG: He told me, in no uncertain words, that by putting stuff in what my former<br />

attorneys did would affect their lives and livelihoods.<br />
