JACKIE HAEG: He did not think they would work.<br />

MR. HAEG: Did he think there was anything better to go with<br />

JACKIE HAEG: Yes he did.<br />

MR. HAEG: And were those the things that we've already talked about<br />

JACKIE HAEG: Yes they are. The ineffective assistance <strong>of</strong> counsel...<br />

MR. HAEG: Ok.<br />

MR. HAEG: Ok and did I ever dis – or did we ever discuss the actions <strong>of</strong> the troopers in my<br />

case<br />

JACKIE HAEG: Yes we have.<br />

MR. HAEG: And what did Mr. Osterman think <strong>of</strong> those actions<br />

JACKIE HAEG: He agreed with you he – he felt that –uh- they were not right either.<br />

MR. HAEG: Ok was any <strong>of</strong> that in the draft brief that Mr. Osterman –uh- gave us<br />

JACKIE HAEG: No it wasn't.<br />

MR. HAEG: Ok -um- I hired Mark Osterman after extremely serious doubts about my former<br />

attorneys. I showed Mr. Osterman my evidence that I'd compiled. Mr. Osterman was in awe <strong>of</strong><br />

what had happened - said it was – paraphrase it – "the biggest sellout that he'd ever seen" and he<br />

thought that when the Court <strong>of</strong> Appeals seen it my conviction would be reversed. He also said<br />

that the prosecutor "stomped on my head with boots" and at the same time my own attorneys<br />

allowed them – allowed him to commit those acts without doing anything. –Uh- Mr. Osterman<br />

also said numerous times that what they did was unbelievable, unacceptable, and that he had just<br />

never seen anything like it. And I have –uh- tapes <strong>of</strong> him stating these things over and over<br />

again. I point blank ask Mr. Osterman that – did he have any compunction against using what<br />

my former attorneys did to help me out <strong>of</strong> the nightmare that I was in and he said "no". He said<br />

he didn't like doing it but he didn't like washing or doing toilets and whatever. About a month<br />

and a half later – well let me like – let me just back up a second here. Mr. Osterman said that I<br />

couldn't bother him for about a month because he'd be compiling everything, utilizing my<br />

arguments as the basis for his appeal. He agreed that Chuck Robinson's basis's were without<br />

merit and that he would be forming an appeal that centered around the issues that I had brought<br />
