OSTERMAN: Ok. So Chuck’s screwed. The point being Cole – there’s no ineffective<br />

assistance claim – or there’s nothing in there that will keep you from not suing Cole. Cole was<br />

not your trial attorney – he did not cause the [d] – cause the downfall. But Cole did cause…<br />

HAEG: He helped and Chuck never – Chuck – Brent was the beginning <strong>of</strong> the landslide<br />

and Chuck’s job was to stop the landslide and all Chuck did was jump on ride the landslide.<br />

OSTERMAN: Cause he thought he could control it.<br />

HAEG: Well not when my constitutional rights and my ability to provide – provide for<br />

my family. I’m not goanna let him just jump onto the landslide.<br />

OSTERMAN: Do you think that Chuck could stand in front <strong>of</strong> a jury and point a finger<br />

at Cole<br />

HAEG: I sure could. If I can why can’t Chuck<br />

OSTERMAN: Not relevant.<br />

HAEG: Why not<br />

OSTERMAN: Cause that’s – irrelevant to a jury – to your jury. He couldn’t do that in<br />

front <strong>of</strong> a jury.<br />

HAEG: He doesn’t do it in front <strong>of</strong> a jury – he just – he should have brought it to the –<br />

the judge…<br />

OSTERMAN: That’s what I said. He thought he could control a landslide. Chuck –<br />

Chuck…<br />

HAEG: What is the reason legitimate reason There is none. Well my attorney that I paid<br />

thousands <strong>of</strong> dollars for comes and tells me “you got screwed and that’s the way it is” and it was<br />

his job to not let me get screwed.<br />

OSTERMAN: Ok. So the documents contained here you have a lot <strong>of</strong><br />

trouble with the first two. You have a little trouble with the 3 rd and you<br />

don’t think that the 4 th and 5 th are tight enough.<br />

HAEG: I didn’t get a fair – this whole system. This whole and I guess I’ll bring it up<br />

because I already brought it up. -Um- would you classify Dale Dolifka as an intelligent man<br />

OSTERMAN: Fairly - yeah.<br />

HAEG: Would you classify him as an honest man<br />
