OSTERMAN: Cause all you’re – you’re not after the ineffective<br />

assistance <strong>of</strong> counsel claim then. You’re after the public humiliation and<br />

embarrassment seg - segment <strong>of</strong> it and it won’t work.<br />

HAEG: Ok. So in other words…<br />

OSTERMAN: The issues…<br />

HAEG: … your attorney lying to you is effective assistance <strong>of</strong> counsel – is that what<br />

you’re saying<br />

OSTERMAN: No. I’m not saying that. I’m saying it’s not an effective argument to the<br />

Court <strong>of</strong> Appeals.<br />

HAEG: If I was on the Court <strong>of</strong> Appeals and this poor bastard comes strolling in and<br />

says, man I can prove that my attorney was lying to me to the tune <strong>of</strong> 50 or 60 thousand dollars<br />

or my attorneys – I would say whew boy you didn’t get your moneys worth there buddy. I don’t<br />

think that you might even gotten effective assistance <strong>of</strong> counsel buddy.<br />

OSTERMAN: Guess what<br />

HAEG: What<br />

OSTERMAN: I’ve written a lot <strong>of</strong> things for the Court <strong>of</strong> Appeals and the Supreme<br />

Court and you’re wrong.<br />

HAEG: So have you wrote to them about attorneys lying to their clients<br />

OSTERMAN: I have as a matter <strong>of</strong> fact.<br />

HAEG: And what’d they have to say about it<br />

OSTERMAN: 9 th Circuit Court <strong>of</strong> Appeals says they don’t care whether you – whether<br />

your attorneys you believe lied to you – you have pro<strong>of</strong> to do it. Did he appear in court and do<br />

his job properly for further mandates his oath <strong>of</strong> <strong>of</strong>f[ice] or his oath <strong>of</strong> duty What do you say<br />

now<br />

HAEG: Well I would say when he’s lying to you about your rights as guaranteed by law<br />

and screwed you out <strong>of</strong> them I’d be pissed.<br />

OSTERMAN: That’s what we talked about in that particular area.<br />
