successfully prevented species from becoming extinct. 12 The rigorous provisi<strong>on</strong>s of theESA work as a safety net to help species survive <strong>on</strong>ce they have declined to the level thatlisting is warranted. Because of this, the NRC did not recommend wholesale changes toESA implementati<strong>on</strong>. It did, however, point out that the ESA has been less effective inpreventing species from declining to levels that require listing in the first place.The NRC also observed that, although <strong>on</strong>e purpose of the ESA is to c<strong>on</strong>serve ecosystems,the Act itself includes little specific guidance in this area. To fix this, the NRCrecommended a focus <strong>on</strong> broader rehabilitati<strong>on</strong> of ecosystem functi<strong>on</strong>s, as part of a movetoward ecosystem-based management. Maintaining healthy, functi<strong>on</strong>ing ecosystems canhelp prevent species from becoming threatened or endangered and avoid some of theec<strong>on</strong>omic disrupti<strong>on</strong> that results when drastic measures must be taken to protect anendangered species. The NRC report also c<strong>on</strong>cluded that the federal focus of the ESAshould be broadened to include other layers of government and n<strong>on</strong>governmental interestsas well. Because humans are part of the ecosystem, comprehensive management planswill need to balance species c<strong>on</strong>servati<strong>on</strong> and human uses.Recommendati<strong>on</strong> 20–1C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to require the Marine Mammal<str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> to coordinate with all the relevant federal agencies through the Nati<strong>on</strong>al <strong>Ocean</strong>Council (NOC), while remaining independent. The NOC should determine whether there is aneed for similar oversight bodies for other marine animals whose populati<strong>on</strong>s are at risk,such as sea turtles.Identifying and Overcoming Gaps in Protecti<strong>on</strong>Several changes are needed in federal law to enhance marine mammal and endangeredspecies protecti<strong>on</strong>. The split of management jurisdicti<strong>on</strong> between two federal agencies,c<strong>on</strong>fusi<strong>on</strong> over the requirements of permit applicati<strong>on</strong>s and approvals, and the lack ofclarity in the definiti<strong>on</strong> of legal terms are all issues that should be addressed.Clarifying Jurisdicti<strong>on</strong> and AuthorityAs noted, the management of marine mammals and endangered species is currentlydivided between NOAA and USFWS. In the case of marine mammals, this split wasintended to be temporary and makes little sense. In the case of endangered species,the split is more logical, but better coordinati<strong>on</strong> and clarity are still needed.The original c<strong>on</strong>gressi<strong>on</strong>al committee reports that accompanied the MMPA in 1972show that C<strong>on</strong>gress did not intend marine mammal jurisdicti<strong>on</strong> to be permanently dividedbetween NOAA and USFWS. 13,14 Rather, House and Senate committees anticipated thecreati<strong>on</strong> of a new Department of Natural Resources that would combine NOAA andUSFWS. The report stated that if the proposed new department did not become a reality,they would reexamine the questi<strong>on</strong> of jurisdicti<strong>on</strong> and c<strong>on</strong>sider placing the entire marinemammal program within a single department. Nevertheless, the jurisdicti<strong>on</strong>al splitremains today.Recommendati<strong>on</strong> 20–2C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to place the protecti<strong>on</strong> of allmarine mammals within the jurisdicti<strong>on</strong> of the Nati<strong>on</strong>al <strong>Ocean</strong>ic and AtmosphericAdministrati<strong>on</strong>.310 A N O CEAN B LUEPRINT FOR THE 21ST C ENTURY
