L. 94–265; 16 U.S.C.§§ 1801 et seq.), it claimed for the nati<strong>on</strong> sovereignrights and exclusive fishery management authorityover all fishery resources within 200 miles of thecoast, and over certain c<strong>on</strong>tinental shelf and anadromousfishery resources even bey<strong>on</strong>d 200 miles. Laterrenamed the Magnus<strong>on</strong>-Stevens FisheryC<strong>on</strong>servati<strong>on</strong> and Management Act (M-S Act), theAct as amended established nati<strong>on</strong>al standards forfishery c<strong>on</strong>servati<strong>on</strong> and management in U.S. waters.The M-S Act also created eight Regi<strong>on</strong>al FisheryManagement Councils composed of state and federalofficials and fishing industry representatives that prepareand amend fishery management plans for certainfisheries requiring c<strong>on</strong>servati<strong>on</strong> and management.The Act also requires that fishery managementplans identify essential fish habitat and protecti<strong>on</strong>and c<strong>on</strong>servati<strong>on</strong> measures for each managedspecies. L. 92–522; 16 U.S.C. §§ 1361 et seq.),NOAA has resp<strong>on</strong>sibility for ensuring the protecti<strong>on</strong>of cetaceans (whales, porpoises, and dolphins) andpinnipeds (seals and sea li<strong>on</strong>s), except walruses.USFWS is resp<strong>on</strong>sible for ensuring the protecti<strong>on</strong> ofwalruses, sea otters, polar bears, and manatees.NOAA and USFWS are required to c<strong>on</strong>sult with theMarine Mammal <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>, also created by theMMPA.
