The legislati<strong>on</strong> was prompted by the anger of U.S. fishermen, especially in the NorthAtlantic and off Alaska, regarding the presence <strong>on</strong> their traditi<strong>on</strong>al fishing grounds ofmassive foreign factory trawlers scooping t<strong>on</strong>s of fish from the sea. The trawlers, manyfrom the Soviet Uni<strong>on</strong>, were able to operate at all hours, even in harsh weather, catchingfish and freezing them <strong>on</strong> the spot. By the end of the 1960s, America had dropped fromsec<strong>on</strong>d to sixth in its share of world fishery catch and a substantial segment of the U.S.commercial fishing industry was in deep trouble. Compared to the large, modern, efficientSoviet trawlers, most U.S. vessels were small and inefficient. Although the U.S. Departmentof State urged C<strong>on</strong>gress to delay acti<strong>on</strong> pending the outcome of global negotiati<strong>on</strong>s <strong>on</strong> theU.N. C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Law of the Sea (LOS C<strong>on</strong>venti<strong>on</strong>), those discussi<strong>on</strong>s were goingslowly, and the pressure to act became overwhelming.The management scheme created by the Magnus<strong>on</strong>–Stevens Act was imaginative, yetcomplicated: Regi<strong>on</strong>al Fishery Management Councils were appointed and required todevelop and submit plans for managing particular species to the Secretary of Commercefor approval. The intenti<strong>on</strong> was to harness regi<strong>on</strong>al expertise in the nati<strong>on</strong>al interest,make full use of scientific data, and give the industry a voice in designing the means of itsown regulati<strong>on</strong>. The Coast Guard was tasked with achieving the law’s main selling point—foreigner fishing fleets out, Americans in—and various measures were developed toencourage new investment in the U.S. fishing fleet. The explicit intent of the statute wasto prevent overfishing, rebuild overfished stocks, and realize the full potential of thenati<strong>on</strong>’s fishery resources. Despite the challenge of persuading fiercely independent fishermento accept restricti<strong>on</strong>s <strong>on</strong> their activities, there was much optimism in the early yearsthat the Magnus<strong>on</strong>–Stevens Act’s ambitious goals would be met.Meanwhile, policy makers were coping with another pressing c<strong>on</strong>cern: the Arab oilembargo triggered by the 1973 Middle East war had a direct impact <strong>on</strong> the lives of milli<strong>on</strong>sof Americans. Heating costs soared, and the simple act of filling up at the local gasstati<strong>on</strong> turned into a nightmare. The country’s vulnerability to disrupti<strong>on</strong>s caused bydependence <strong>on</strong> uncertain supplies of foreign oil became a major ec<strong>on</strong>omic and nati<strong>on</strong>alsecurity issue. In resp<strong>on</strong>se, the Nix<strong>on</strong> administrati<strong>on</strong> proposed a massive expansi<strong>on</strong> ofouter C<strong>on</strong>tinental Shelf (OCS) oil and gas leasing to include fr<strong>on</strong>tier areas off the Atlantic,Gulf, and Pacific coasts. This proposal ran counter to the pro-envir<strong>on</strong>mental currents thencirculating, and posed a challenge to lawmakers searching for a way to address ecologicaland energy supply c<strong>on</strong>cerns simultaneously. The result was the OCS Lands ActAmendments of 1978, the product of three years of bipartisan legislative effort, designedto encourage leasing subject to new planning requirements, more rigorous envir<strong>on</strong>mentalstandards, and measures to ensure that the views of state and local governments weretaken into account.The many ocean-related laws spawned during the 1970s addressed urgent needs,introduced creative management c<strong>on</strong>cepts, and multiplied the scope of federal resp<strong>on</strong>sibility.But they lacked an overarching visi<strong>on</strong> critical to a coherent nati<strong>on</strong>al ocean policy.NOAA was neither equipped nor authorized to set priorities across more than a small porti<strong>on</strong>of the spectrum of marine activities, and most of the laws enacted were aimed at asingle purpose or ocean use, and implemented with little reference to others.The inherent difficulty of managing diverse activities over a vast geographic area,and the incremental manner in which the federal ocean regime was assembled, inevitablyresulted in fragmentati<strong>on</strong>. The three presidents who served between 1969 and 1981 didnot provide str<strong>on</strong>g policy directi<strong>on</strong> <strong>on</strong> ocean issues. In the absence of such directi<strong>on</strong>,neither the executive branch nor C<strong>on</strong>gress was structured in a way that fostered a comprehensiveapproach to the oceans. No federal department could claim the lead, andcrosscutting legislative initiatives were referred to multiple c<strong>on</strong>gressi<strong>on</strong>al committeeswhere differing perspectives tended to cancel each other out. Notwithstanding theStratt<strong>on</strong> <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>’s call for centralizati<strong>on</strong>, by 1980 federal resp<strong>on</strong>sibility for oceanrelatedprograms was distributed am<strong>on</strong>g ten departments and eight independent agencies.52 A N O CEAN B LUEPRINT FOR THE 21ST C ENTURY
