(H) Recommendati<strong>on</strong>s for any modificati<strong>on</strong>s to United States laws, regulati<strong>on</strong>s, and theadministrative structure of Executive agencies, necessary to improve the understanding,management, c<strong>on</strong>servati<strong>on</strong>, and use of, and access to, ocean and coastal resources.(I) A review of the effectiveness and adequacy of existing Federal interagency oceanpolicy coordinati<strong>on</strong> mechanisms, and recommendati<strong>on</strong>s for changing or improving theeffectiveness of such mechanisms necessary to resp<strong>on</strong>d to or implement the recommendati<strong>on</strong>sof the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>.(3) CONSIDERATION OF FACTORS—In making its assessment and reviews and developingits recommendati<strong>on</strong>s, the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> shall give equal c<strong>on</strong>siderati<strong>on</strong> to envir<strong>on</strong>mental, technicalfeasibility, ec<strong>on</strong>omic, and scientific factors.(4) LIMITATIONS—The recommendati<strong>on</strong>s of the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> shall not be specific to the landsand waters within a single State.(g) PUBLIC AND COASTAL STATE REVIEW—(1) NOTICE—Before submitting the final report to the C<strong>on</strong>gress, the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> shall—(A) publish in the Federal Register a notice that a draft report is available for publicreview; and(B) provide a copy of the draft report to the Governor of each coastal State, theCommittees <strong>on</strong> Resources, Transportati<strong>on</strong> and Infrastructure, and Science of the House ofRepresentatives, and the Committee <strong>on</strong> Commerce, Science, and Transportati<strong>on</strong> of the Senate.(2) INCLUSION OF GOVERNORS’ COMMENTS—The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> shall include in the finalreport comments received from the Governor of a coastal State regarding recommendati<strong>on</strong>s in the draftreport.(h) ADMINISTRATIVE PROCEDURE FOR REPORT AND REVIEW— Chapter 5 and chapter 7 of title5, United States Code, do not apply to the preparati<strong>on</strong>, review, or submissi<strong>on</strong> of the report required bysubsecti<strong>on</strong> (e) or the review of that report under subsecti<strong>on</strong> (f).(i) TERMINATION—The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> shall cease to exist 90 3 days after the date <strong>on</strong> which it submitsits final report.(j) AUTHORIZATION OF APPROPRIATIONS—There are authorized to be appropriated to carry outthis chapter a total of $8,500,000 4 for the 3-fiscal-year period beginning with fiscal year 2001, such sums toremain available until expended.Secti<strong>on</strong> 4. Nati<strong>on</strong>al <strong>Ocean</strong> <strong>Policy</strong>(a) NATIONAL OCEAN POLICY—Within 90 5 days after receiving and c<strong>on</strong>sidering the report andrecommendati<strong>on</strong>s of the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> under secti<strong>on</strong> 3, the President shall submit to C<strong>on</strong>gress a statement ofproposals to implement or resp<strong>on</strong>d to the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>’s recommendati<strong>on</strong>s for a coordinated, comprehensive,and l<strong>on</strong>g-range nati<strong>on</strong>al policy for the resp<strong>on</strong>sible use and stewardship of ocean and coastal resources for thebenefit of the United States. Nothing in this Act authorizes the President to take any administrative orregulatory acti<strong>on</strong> regarding ocean or coastal policy, or to implement a reorganizati<strong>on</strong> plan, not otherwiseauthorized by law in effect at the time of such acti<strong>on</strong>.(b) COOPERATION AND CONSULTATION—In the process of developing proposals for submissi<strong>on</strong>under subsecti<strong>on</strong> (a), the President shall c<strong>on</strong>sult with State and local governments and n<strong>on</strong>-Federalorganizati<strong>on</strong>s and individuals involved in ocean and coastal activities.3 Public Law 107–372 (secti<strong>on</strong> 306)4 Public Law 107–372 (secti<strong>on</strong> 306)5 Public Law 107–372 (secti<strong>on</strong> 306)A PPENDIX A: OCEANS A CT OF 2000 A 5
