Recommendati<strong>on</strong> 19–27The Nati<strong>on</strong>al <strong>Ocean</strong> Council (NOC) should initiate a discussi<strong>on</strong> <strong>on</strong> effective internati<strong>on</strong>alimplementati<strong>on</strong> of the United Nati<strong>on</strong>s Food and Agriculture Organizati<strong>on</strong>’s Code of C<strong>on</strong>ductfor Resp<strong>on</strong>sible Fisheries and other Plans of Acti<strong>on</strong>.In particular, the NOC’s internati<strong>on</strong>al committee should suggest methods to encouragenati<strong>on</strong>s to:• join relevant regi<strong>on</strong>al fishery management organizati<strong>on</strong>s.• implement and enforce regi<strong>on</strong>al agreements to which they are bound.• collect and report the data necessary to manage fish stocks sustainably and to reducefishery impacts <strong>on</strong> habitats and protected species.• reduce or eliminate illegal, unreported, and unregulated fishing by ships flying their flag.• reduce fishing fleet capacity, particularly <strong>on</strong> the high seas.• reduce bycatch of n<strong>on</strong>-targeted species, in particular endangered populati<strong>on</strong>s such as seaturtles and marine mammals, via the use of innovative gear and management methodssuch as <strong>on</strong>board observer programs.Chapter 20: Protecting Marine Mammals and Endangered Marine SpeciesRecommendati<strong>on</strong> 20–1C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to require the Marine Mammal<str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> to coordinate with all the relevant federal agencies through the Nati<strong>on</strong>al <strong>Ocean</strong>Council (NOC), while remaining independent. The NOC should determine whether there is aneed for similar oversight bodies for other marine animals whose populati<strong>on</strong>s are at risk,such as sea turtles.Recommendati<strong>on</strong> 20–2C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to place the protecti<strong>on</strong> of all marinemammals within the jurisdicti<strong>on</strong> of the Nati<strong>on</strong>al <strong>Ocean</strong>ic and Atmospheric Administrati<strong>on</strong>.Recommendati<strong>on</strong> 20–3The Nati<strong>on</strong>al Marine Fisheries Service and U.S. Fish and Wildlife Service, with guidance fromthe Nati<strong>on</strong>al <strong>Ocean</strong> Council, should significantly improve their coordinati<strong>on</strong> with respect tothe implementati<strong>on</strong> of the Endangered Species Act, particularly for anadromous species andsea turtles, and in circumstances where land-based activities have significant impacts <strong>on</strong>marine species.Recommendati<strong>on</strong> 20–4The U.S. Fish and Wildlife Service and Nati<strong>on</strong>al <strong>Ocean</strong>ic and Atmospheric Administrati<strong>on</strong>should expand their cooperative agreements with states under Secti<strong>on</strong> 6 of the ESA, includingenhanced research, management, m<strong>on</strong>itoring, and public informati<strong>on</strong>.Recommendati<strong>on</strong> 20–5C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to require the Nati<strong>on</strong>al <strong>Ocean</strong>icand Atmospheric Administrati<strong>on</strong> to more clearly specify categories of activities that areallowed without authorizati<strong>on</strong>, those that require authorizati<strong>on</strong>, and those that are prohibited.Recommendati<strong>on</strong> 20–6C<strong>on</strong>gress should amend the Marine Mammal Protecti<strong>on</strong> Act to revise the definiti<strong>on</strong> of harassmentto cover <strong>on</strong>ly activities that meaningfully disrupt behaviors that are significant to thesurvival and reproducti<strong>on</strong> of marine mammals.508 A N O CEAN B LUEPRINT FOR THE 21ST C ENTURY
