This obligationexists regardless of which parent has custody.State Guidelines Federal regulations require that every state adoptchild support guidelines. The guidelines must:l Take into consideration all earnings and income of the noncustodialparent.l Have specific criteria and a mathematical formula that determine thesupport obligation.l Provide for the children’s healthcare needs, through insurancecoverage or other means.Federal regulations also recommend that states adhere to the followingprinciples in their establishing guidelines:l Both parents should share responsibility for support of their childrenin proportion to their income.l The subsistence needs of each parent should be considered, but thechild support obligation should never be set at zero.l Child support must cover a child’s basic needs, plus ensure that thechild is entitled to share in a parent’s standard of living.l Each child has an equal right to share in his or her parent’s income,subject to the child’s age, the parent’s income, income of a currentspouse, and other dependents.l Each child is entitled to support, even if the parents were not marriedat the time of his or her birth.l A guideline should encourage the involvement of both parents in thechild’s upbringing.
