APPENDIX AAmendment IXThe enumeration in the Constitution, ofcertain rights, shall not be construed to denyor disparage others retained by the people.Amendment XThe powers not delegated to the United Statesby the Constitution, nor prohibited by it to theStates, are reserved to the States respectively,or to the people.Amendment XIThe Judicial power of the United States shallnot be construed to extend to any suit in law orequity, commenced or prosecuted against oneof the United States by Citizens of anotherState, or by Citizens or Subjects of anyForeign State.Amendment XIIThe Electors shall meet in their respectivestates and vote by ballot for President andVice-President, one of whom, at least, shallnot be an inhabitant of the same state withthemselves; they shall name in their ballots theperson voted for as President, and in distinctballots the person voted for as Vice-President,and they shall make distinct lists of all personsvoted for as President, and of all persons votedfor as Vice-President, and of the number ofvotes for each, which lists they shall sign andcertify, and transmit sealed to the seat of thegovernment of the United States, directed tothe President of the Senate; the President ofthe Senate shall, in the presence of the Senateand House of Representatives, open all thecertificates and the votes shall then becounted; The person having the greatest numberof votes for President, shall be the President,if such number be a majority of thewhole number of Electors appointed; and if noperson have such majority, then from the personshaving the highest numbers not exceedingthree on the list of those voted for asPresident, the House of Representatives shallchoose immediately, by ballot, the President.But in choosing the President, the votes shallbe taken by states, the representation from eachstate having one vote; a quorum for this purposeshall consist of a member or membersfrom two-thirds of the states, and a majority ofall the states shall be necessary to a choice.And if the House of Representatives shall notchoose a President whenever the right ofchoice shall devolve upon them, before thefourth day of March next following, then theVice-President shall act as President, as incase of the death or other constitutionaldisability of the President.The person having the greatest number ofvotes as Vice-President, shall be the Vice-President, if such number be a majority of thewhole number of Electors appointed, and if noperson have a majority, then from the twohighest numbers on the list, the Senate shallchoose the Vice-President; a quorum for thepurpose shall consist of two-thirds of thewhole number of Senators, and a majority ofthe whole number shall be necessary to achoice.
