The TrialIf the defendant requests a jury trial, selection of jurors proceedsand attorneys make opening statements and introduce evidence.Otherwise, the case is tried before the judge, who decides the verdict. The trial ends with the attorney’s closing statements and the judge’sinstructions to the jury.In a criminal case with a jury, the verdict must be unanimous—either guilty beyond a reasonable doubt, or not guilty. A mistrial iscalled if the jury cannot agree, and a new trial may be held at theoption of the prosecution. If the defendant is not guilty, he or she isreleased. If the defendant is found guilty, the judge imposes a sentencein the form of a fine, imprisonment, or both.SentencingAfter a person has been convicted of a crime, he or she is sentencedby the court, which means the judge decides the punishment. The law provides certain sentencing guidelines and penalties, includingfines, imprisonment, and even death.Fines A fine is the payment of money as a penalty for committinga crime, generally a minor one. Fines are also attached to more seriouscrimes and may be levied by the judge along with imprisonment.Imprisonment States deal with imprisonment in different ways. Insome states, the judge may hand down an indefinite or indeterminatesentence, ordering a minimum and maximum amount of time the convictedcriminal may spend in prison. A prisoner might be sentenced tofive to ten years; however, good behavior might shorten his or her timebehind bars.Other states insist on compelling the judge to use a definite sentence. The judge must state the exact period of time a criminal willspend in prison. Some states have created mandatory sentences forcertain crimes, which cannot be altered for any reason.Giving EvidenceImagine that yourfriend’s brother hasbeen arrested for committinga crime thatoccurred last weekend. You saw your friend’sbrother at a party atthe time the crime wascommitted and arecertain that he is innocent. However, yourparents told you not toattend the party, andyou’re sure that youwill get in trouble ifyou come forward withyour evidence.
