ETO Case 000­50­5­11, U.S. v. Andreas Battermann et al., was tried at Dachau,<br />

Germany, during the period June 26–1 July 1947, before a General Military<br />

Government Court. The case concerned nine defendants accused of participating<br />

in the operations of Mauthausen Concentration Camp <strong>and</strong> its sub­<strong>camp</strong>s <strong>and</strong><br />

thereby,on the principal of common design,implicated in mass atrocities <strong>and</strong> oth­<br />

er war crimes. All of the convicted accused, listed below, were members of the SS<br />

associated with the administration <strong>and</strong> operation of Gusen Concentration Camp.<br />

Andreas Battermann – Waffen SS sergeant, guard<br />

Felix Domingo (not tried)<br />

Albert Fitzner – Waffen SS corporal, guard<br />

Gert Hausknecht – Waffen SS corporal, guard<br />

Michael Jait – Waffen SS sergeant, guard at Gusen, Wiener­Neudorf, <strong>and</strong><br />

Ebensee<br />

Rudolf Gustav Klein – Waffen SS technical sergeant, guard, <strong>and</strong> assistant<br />

block leader<br />

Otto Richard Kleinert – Waffen SS corporal, guard<br />

Victor Kremer (not tried)<br />

Adolf Mohr – Waffen SS sergeant, guard<br />

Of the accused, Domingo <strong>and</strong> Kremer did not come to trial. As approved<br />

by the reviewing authority, Kleinert <strong>and</strong> Mohr were given prison sentences<br />

of 2 years; Battermann <strong>and</strong> Hausknecht, 3 years; <strong>and</strong> Fitzner <strong>and</strong> Jait, 10<br />

years. Klein was sentenced to death.<br />
