5.4.1 Insurance Commissioner’s<br />

Certification (ICC)<br />

Following a disaster, the Robert T. Stafford<br />

Disaster Relief and Emergency Assistance Act<br />

An ICC is the best way to<br />

ensure continued eligibility<br />

for FEMA PA.<br />

(Stafford Act) requires Applicants to obtain<br />

and maintain (O & M) insurance, provided that<br />

insurance is reasonably available, to be eligible<br />

for FEMA Public Assistance (PA) funding in a<br />

subsequent disaster. This is often referred to as the O & M requirement. To meet the O & M<br />

requirement, insurance coverage must be:<br />

• Obtained and maintained on all damaged facilities that received FEMA PA funding.<br />

• At least equal to the value of the eligible damage to the facility and for the specific<br />

hazard that caused the damage.<br />

Insurance market conditions sometimes prevent an Applicant’s ability to reasonably meet<br />

the O & M requirement. The Stafford Act then allows an Applicant to apply for an Insurance<br />

Commissioner’s Certification (ICC). The ICC acts as a declaration that some portion of the O & M<br />

requirement is not reasonably available to the FEMA PA Applicant.<br />

ICC Criteria<br />

The Louisiana Commissioner of Insurance, working with <strong>GOHSEP</strong>, has established criteria<br />

an Applicant must meet to be eligible for an ICC:<br />

• Applicant must demonstrate reasonable attempts to obtain and maintain insurance<br />

in the amounts required by the Stafford Act.<br />

• Must establish a minimum insurance budget.<br />

• Must follow a specified insurance procurement procedure that includes<br />

purchasing the maximum amount of insurance available through the National<br />

Flood Insurance Program (NFIP).<br />

• Schedule coverage when using blanket insurance policies, pooling arrangements,<br />

layered policy arrangements or some combination of those options.<br />

• Deductibles cannot exceed 15 percent of property insurance coverage.<br />
