§ 725.1. Legal representative of office; state attorney general<br />

The attorney general shall be the legal advisor to the Governor's Office of Homeland Security and<br />

Emergency Preparedness and, except as otherwise provided by law, shall counsel and advise the<br />

office and shall represent it in any and all matters when called upon to do so.<br />

§ 725.2. Confidentiality of certain records<br />

A. (1) Notwithstanding any other provision of law to the contrary, records in the custody of the<br />

Governor's Office of Homeland Security and Emergency Preparedness containing certain security<br />

sensitive information which shall be the same type of information as described in R.S. 44:3.1 and<br />

3.2 shall be deemed confidential.<br />

(2) Such nondisclosure shall not apply to necessary use by duly authorized officers or employees<br />

of state, federal, or local government in carrying out their responsibilities as provided by applicable<br />

state law or applicable federal law.<br />

B. The provisions of this Section shall not prevent any person from examining and copying any<br />

books, records, papers, accounts, or other documents of the Governor's Office of Homeland Security<br />

and Emergency Preparedness, except as provided in Subsection A of this Section. Such<br />

records shall not be subject to the provisions of R.S. 44:5.<br />

C. If a public record is applied for during an imminent threat of a disaster or emergency or during<br />

a disaster or emergency, the office shall immediately notify the requestor as to the reasons why<br />

such record shall not be immediately available.<br />
