<strong>Report</strong> <strong>of</strong> <strong>the</strong> <strong>Bahrain</strong> <strong>Independent</strong> <strong>Commission</strong> <strong>of</strong> <strong>Inquiry</strong><br />

and technocrats who enjoy <strong>the</strong> confidence and<br />

acceptance <strong>of</strong> <strong>the</strong> people, and who are known for being<br />

free from corruption and unstained by <strong>the</strong> blood <strong>of</strong> <strong>the</strong><br />

people.<br />

iv. The constitutional proclamation should stipulate that a<br />

Constituent Assembly should be elected within 45<br />

days. To ensure that it fairly represents <strong>the</strong> people, <strong>the</strong><br />

members <strong>of</strong> this assembly should be chosen by an<br />

election for which all <strong>of</strong> <strong>Bahrain</strong> is a single electoral<br />

district.<br />

v. This assembly shall draft a new constitution, which<br />

shall be adopted in its entirety by a 3/5 majority <strong>of</strong> <strong>the</strong><br />

assembly. The constitution shall include <strong>the</strong> following<br />

principles:<br />

1. The King shall be from <strong>the</strong> Al Khalifa family,<br />

who shall reign but not rule over a genuine<br />

democratic constitutional monarchy.<br />

2. Governance is by <strong>the</strong> people, and shall be<br />

exercised through a democratically elected<br />

government.<br />

3. A freely elected legislative council shall have<br />

exclusive legislative, financial and oversight<br />

powers.<br />

4. The judicial branch <strong>of</strong> government shall be fully<br />

independent from all o<strong>the</strong>r authorities.<br />

vi. The Constituent Assembly shall also adopt <strong>the</strong> Political<br />

Rights Law and <strong>the</strong> provisions governing <strong>the</strong> electoral<br />

process.<br />

vii. The Constituent Assembly shall draft <strong>the</strong> constitution<br />

and o<strong>the</strong>r laws that are necessary for constitutional life<br />

within four months.<br />

viii. The constitution shall be applicable once approved by<br />

<strong>the</strong> Constituent Assembly. The branches <strong>of</strong><br />

government shall be restructured in accordance with<br />

<strong>the</strong> new constitution within 9 months.<br />

ix. During <strong>the</strong> transition period, no laws or decree laws<br />

shall be issued, except if necessary. The Constituent<br />

Assembly shall determine with a 2/3 majority that this<br />

situation necessitates <strong>the</strong> issuing <strong>of</strong> such laws or decree<br />

laws.<br />

x. The elections for <strong>the</strong> Constituent Assembly shall be<br />

held in accordance with <strong>the</strong> Political Rights Law, and<br />

in a manner that does not prejudice this proclamation.<br />
